Purpose:

To authorise the funding injection of £570,451 from the Learning Places Capital Risk Fund to supplement the previously approved £3.25m allocated to the Learning Places Programme expansion of Bramley Primary School.  This additional funding is required to cover the increase in project scope agreed in consultation with the Head of Learning Improvement and Executive Member for Childrens & Families following consultation with local ward members and the school governing body.  The additional scope will cover works required to provide further enhancements to teaching and learning in line with OFSTED recommendations and allow a project contingency commensurate with the scale and complexity of the project at Bramley.  This funding injection will increase the project budget to £3,820,451, with any underspend following completion being returned to the Capital Risk Fund, and allow the tender to be awarded and construction contract to be entered into.  These works are required for the commencement of the September 2017 academic year and is necessary to ensure sufficient pupil places are available for this date.

Decision:

The Director of Childrens & Families agreed to:

1.  Approve the expenditure of £3,820,451 from capital scheme number 32450/BRA/000 for the construction work associated with the expansion of Bramley Primary School necessary for occupation from September 2017.  Please note, the above includes £826,000 of previous approvals attributable to the ‘early works’ requirement on this scheme.

 

2.  To approve a Programme Capital Risk application for the sum of £570,451 for additional works added into the scheme at the request of the Executive Member for Children’s and Families, the Head of Learning Improvement and the Bramley local ward members.

 

3.  Authorise acceptance of the tender submitted by the LLEP in the sum of £3,397,877.12, inclusive of all design fees, development costs and surveys.  Please note, this includes £826,000 of previous approvals attributable to the ‘early works’ requirement on this scheme.

 

4.  Sanction the requirement to enter into a contractual agreement with Leeds D&B One Ltd. to deliver the expansion project at Bramley Primary School. This will take the form of a JCT 2016 contract between the Authority and Leeds D&B One Ltd. for the sum of £3,397,877.12.  For contractual purposes this figure includes previous approvals, totalling £826,000, required to facilitate the ‘Early Works’ programme necessary to meet the critical path programme for the expansion of Bramley Primary School.

 

5.  Note that the breakdown of project costs, highlighted in section 1.0 above, are detailed within section 5.5 of this report.

 

6.  Note the programme dates identified in section 4.0 of this report, in relation to the implementation of this decision, represents the critical path for project success and must be adhered to where possible. 

 

7.  Note that the officer responsible for implementation is the Head of Service Learning Systems.

If the decision has not been published in the List of Forthcoming Key Decisions for at least 28 clear days, the reason why it would be impracticable to delay the decision:: Due to the late receipt of the final scheme cost, which included the scope additions covered under the funding injection request, it has not been possible to submit a Key Decision form earlier to allow a full 28 day clearance period. The final cost plan was issued to Leeds City Council on Tuesday 2nd May 2017. Due to this late receipt of information, the costs exceeding the original funding approval in excess of £250k and the time critical nature of the delivery programme it is necessary to invoke the ‘General Exception’ rule in this instance.

Consultation has been on-going with the school management team, LCC Highways & LCC Planning Department. Ward member briefings are being issued periodically at key points in the project programme. The Executive Member for Children & Families and the Head of Learning Improvement have been directly involved with the agreement of extending project scope with the associated parties.
