Decision details

The Head of Service, Learning Systems agreed to:
* note the negotiations held with Solicitors acting on behalf of the Governing Body of East Ardsley Primary School, The Leodis Academies Trust and the DfE;
* give authority for the following agreements ("The Agreement") to be executed and completed to enable the Academy to open on 1st June 2016, (subject to the PFI Funders/Banks approval):
- Schools Agreement;
- Principal Agreement;
- Deed of Variation;
- Long Term Lease; and
- Commercial Transfer Agreement;
together with any other documentation required to complete the transfer;
* note that a Local Government (Contracts Act) certificate will be signed by the Director of Children's Services (as approved by the City Solicitor and the Deputy Chief Executive) in relation to the Deed of Variation, to be issued at close;
* give authority for the City Solicitor to give indemnity to the Director of Children's Services in respect of the signature of the Local Government (Contracts Act) 1997 certificate to the Deed of Variation; and
* give authority for any other necessary action to be taken to effect the transfer.
