The Chief Officer (Highways and
Transportation):
i) noted the principles of the highway works as outlined in Section
3.2 and shown indicatively on drawing
732641/LCC/HWT/XX/DR/EP/GA_01_ as shown at Appendix 3 of this
report;
ii) gave authority to negotiate the terms of and enter into an
agreement with the developer under the provisions of Section 278 of
the Highways Act 1980; whereby the works associated with the
development are carried out by this Council at the cost of the
developer;
iii) gave authority to incur expenditure of £219,821 works
costs and £43,964 staff costs to be fully funded by a
developer through a Section 278 Agreement;
iv) requested the City Solicitor to:
1. Advertise a notice to amend an existing Traffic Regulation Order
associated with the existing on-street parking bay affected by the
relocation of the bus stop; and if no valid objections are
received, to make and seal the TRO as advertised;
2. Advertise a notice under the provisions of Section 23 of the
Road Traffic Regulation Act 1984 to establish a pedestrian crossing
facility as shown on drawing 732641/LCC/HWT/XX/DR/EP/GA_01_;
and
v) Noted and approved the changes to the adopted Highway boundary
proposed as part of the works as described in section 3.2. The area
shown in purple on the attached Proposed Adopted Highway Plan,
included as Appendix 4, will be the resultant area of adopted
Highway; and
vi) gave authority to carry out the detailed design, tender and
implement the works as set out in Section 3.2.
