Election of the Chair

Minutes:

RESOLVED – Councillor Wilkinson was elected Chair for the duration of this meeting.

 

24.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2) To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application  as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

''Bayswater Supermarket'' - Review of a Premises Licence for Bayswater Supermarket, 5 Bayswater View, Harehills, Leeds LS8 5LQ pdf icon PDF 103 KB

To consider the report of the Head of Licensing and Registration on an application for a Review of the premises licence held by Bayswater Supermarket, 5 Bayswater View, Harehills, Leeds LS8 5LQ. The application has been made by the West Yorkshire Police under Section 51 of the Licensing Act 2003.

 

Appendix D is exempt under Access to Information Procedure Rule 10.4 (2)

The Sub-Committee considered an application for the review of a Premises Licence under Section 51 of the Licensing Act 2003, submitted by West Yorkshire Police in respect of Bayswater Supermarket, 5 Bayswater View, Harehills, Leeds, LS8 5LQ.

 

Appendix D to the report was designated exempt under the provisions of Paragraph 14 of the Licensing Act 2003 (Hearings Regulations 2005) and under the provisions of Access to Information Procedure Rule 10.4(2).

 

The hearing was attended by the following:

 

  • Inspector Harrison, West Yorkshire Police
  • PC Dobson, West Yorkshire Police
  • Mr Patterson, West Yorkshire Police
  • Mr Rasal Ahmed, Premises Licence Holder.

 

PC Dobson addressed the Sub-Committee and made the following points:

 

  • The negative impact of the premises on the local area.  Local residents were too afraid to voice their concerns as they feared reprisals.
  • The premises had failed 3 underage test purchases.  An action planning meeting had taken place with the Premises Licence Holder, but no due diligence had been demonstrated.

 

Inspector Harrison addressed the Sub-Committee and made the following points:

 

  • Some of the worst anti-social behaviour in East Leeds.  There were concerns that the anti-social behaviour was getting worse.
  • There was a serious need to reduce alcohol fuelled behaviour in the area linked to concerns about young people’s health and safety.
  • The sale of alcohol to underage children was undermining the positive work being undertaken in the local community, e.g. healthy living initiatives, etc.

 

Mr Ahmed, Premises Licence Holder, addressed the Sub-Committee and made the following points:

 

  • There had been a recent test purchase which the premises had passed.
  • The Premises Licence Holder was a victim of anti-social behaviour and had not contributed to the issues that had been raised. 

 

In response to questions, the following points were made:

 

  • CCTV at the premises was not working at present.
  • The Premises Licence Holder did not maintain a refusals log or register.
  • Staff were trained to adopt check 25 policy.

 

RESOLVED – That the Premises Licence be revoked.
