Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2) To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application  as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

To consider the report of the Head of Licensing and Registration on an application received for the grant of a licence for AS Convenience Store, 1A Shafton Lane, Holbeck, LS11 9LY

The Licensing Sub Committee considered an application for the grant of a Premises Licence for the premises known as AS Convenience Stores, 1 Shafton Lane, Holbeck, Leeds LS11 9LY. This was the first application made for a licence for these premises.

 

The application had attracted a representation from West Yorkshire Police. The Sub Committee noted that the applicant had agreed to the measures suggested by WYP to address the crime and disorder licensing objective; and the representation had been withdrawn on the understanding that these measures would be included within the premises licence, should this application be granted.

 

One further representation had been received from a member of the public who did not attend the hearing. Members heard from the licensing officer in respect of the efforts made to contact the objector without success and the status of the representation. Members resolved to proceed with the hearing whilst taking the contents of the representation into consideration.

 

Mrs Stella Bhebhe and Mr Andrew Bhebhe (the applicants) attended the hearing, two observers were also in attendance.

 

The Sub Committee heard from Mrs Bhebhe who outlined the application and the efforts she had made to contact the members of the public who had made representation. Mrs Bhebhe then addressed the concerns raised in the representation and outlined the measures proposed to ensure appropriate alcohol sales

 

The Sub Committee, having carefully considered the application, the written representation and the information supplied at the hearing, along with the licensing objectives and S182 Guidance

RESOLVED – To grant the application as requested:

Sale of alcohol

Monday to Saturday   11:00 hours until 22:00 hours

Sundays  11:00 hours until 20:00 hours

To consider the re[port of the Head of Licensing and Registration on an application to vary an existing premises licence at Bargain Booze, 57 – 59 Main Street, Garforth, Leeds, LS25 1AF

The Licensing Sub Committee considered an application to vary an existing Premises Licence held at Bargain Booze Select Convenience, 57-59 Main Street, Garforth Leeds LS25 1AF.

 

The application had attracted 2 individual representations from members of the public. No representations had been submitted by the responsible authorities. The members of the public did not attend the hearing. Members resolved to proceed with the hearing whilst taking the contents of the representations into consideration.

 

Mrs Gill Sherrat, agent for the licence holder and Mr Derek Rickard, manager of the premises, attended the hearing.

 

The Sub Committee heard from Mrs Sherrat who outlined the licensed history of the premises, the management team and explained the rationale behind the application. Mrs Sherrat confirmed that no complaints had been received about the premises since the first grant of a premises licence in 2010. Mrs Sherrat and Mr Rickard also addressed the concerns contained within the representations regarding ant social behaviour and litter.

 

The Sub Committee, having carefully considered the application, the written representations and the information supplied at the hearing, along with the licensing objectives and S182 Guidance

RESOLVED – To grant the application as requested:

a)  Sale of alcohol  Monday to Sundays  07:00 hours until 23:00 hours

b)  To remove seasonal variations
