The Deputy Chief Executive has approved in
accordance with clause 22.1 of the Contract Procedure Rules, it has
been agreed that the above contract with BE Group is to be
terminated due to the Contractor being unable to complete all of
the outputs specified under phase 1 of the service specification
within a reasonable timescale.
The contract has been terminated with immediate effect in line with
clause H3.2 of the terms and conditions, which states:
"Notwithstanding clause H3.1 the Contractor acknowledges that phase
2 [of the contract] is subject to the satisfactory completion of
phase 1 and agrees that the Council may, at its sole discretion,
terminate this Contract at the end of phase 1 with immediate
effect".
