15/12/2014 - Extinguishment of a Footpath between Chapel Yard and Chapel Street, Halton, Leeds ref: 41886    For Determination

The Natural Environment Manager did not to authorise the City Solicitor to make an Extinguishment Order under the Town and Country Planning Act 1990 for the footpath between Chapel Yard and Chapel Street, Halton for the following reasons:

(a) There is no physical building work to be carried out over the line of the footpath, only gardens and fences. Public rights of way can run through gardens, therefore it is not considered necessary for the footpath to be extinguished to allow the development to be carried out.
(b) Provision could also have been made to divert the footpath through the central courtyard and then down to and along the southern boundary of the site to join the existing footpath at the north western corner of the library. Diversions are always preferable to outright extinguishment.
(c) The footpath provides a well-used link between the library and other local facilities for local residents including by nursery school children. The alternative route involves the use of a narrow pavement alongside a busy road where the width is reduced by a bus stop. The effects of the Order on those entitled to use it should be taken into account before confirming an Extinguishment Order.
(d) The footpath provides the only access to an adjoining property’s bin store and no attempt has been made to provide alternative access or provision. The effects of the Order on those entitled to use it should be taken into account before confirming an Extinguishment Order.
(e) The applicant has already commenced work on site and is expected to complete the development by the end of November or beginning of December. Public Path Extinguishment Orders under the Town and Country Planning Act 1990 cannot be made or confirmed if the development is already substantially complete.

It is recommended that the Director of Public Health –

Authorises to Waives Contracts Procedure Rule 15.2. so that the tender for a 9 month pilot project for a Long Term Conditions Supportive Structured Self-Management Programme is evaluated based solely on quality to procure to the full value of funding made available via external funding from the three CCG’s. The Agreement from the 3 CCG’s was that the full amount was allocated for this pilot programme. As this is a pilot which will help inform future commissioning of structured education for people with LTC’s it is recommended that the evaluation of the tender is based soley on quality.

The three CCG’s in Leeds have funded the design, delivery and evaluation of a 9 month bespoke pilot structured education programme for people with LTC’s to the value of 185K . With approval the funding was transferred to LCC for full procurement. It is recommended that the evaluation of the tenders be based on quality as the full amount of the external funding is to be used for this pilot. Once the pilot is completed it will help to inform future commissioning of structured edcuation programmes in Leeds. (please see attached waiver for more information)

This pilot programme will be governed by the Self-Management workstream which is part of the Integrated Care and Prevention Board (ICP). The ICP sits beneath and reports directly to the Leeds Health and Social Care Transformation ‘Portfolio’ Board which is aligned to the outcomes of the Health and Wellbeing Board.

As part of the transfer to the Council, the three contracts held with Leeds Community Healthcare NHS Trust, Leeds Teaching Hospitals NHS Trust and Leeds and York Partnership Foundation NHS Trust were reviewed and were provided with new contracts based on Department of Health/Local Authority terms and conditions starting from 1st April 2013 for one year with the provision to extend for a further 2 x 12 months (maximum of 3 years).  The total value of these contracts is £4.8 million.

These contracts provide key public health services including weight management, healthy lifestyle, smoking cessation, school nurses, infection control and other smaller contracts. These services are required to support the mandatory and statutory public health responsibilities of the Council, and to contribute towards meeting the outcomes set out in the health and wellbeing strategy. 

As part of this extension process; all of the services have been subject to a review in terms of need, performance and providing value for money.  Some minor contract variations are proposed as an outcome of this review.

These contract extensions enable the Public Health Directorate to continue to work with the Public Private Partnerships and Procurement Unit (PPPU & PU) to develop their strategic commissioning priorities and undertake a structured staged approach to re-commissioning which can be resourced effectively in order to obtain the best quality and value for money solution for the Council and the citizens of Leeds.
