Decisions

The Head of Engineering Services:

i) noted the contents of the report; and

ii) approved the application from Hotel Chocolat, for a licence to operate a street café on the highway at Albion Street, Leeds 1 ,as shown on the attached numbered drawing 068B, to expire on the 31 March 2015 and that future licences be renewed annually, subject to satisfactory operation, and with approval from The Chief Officer Highways and Transportation.

The Head of Strategic Development and Investment agreed to authorise expenditure of £150,000 for the purchase of furniture and IT equiment for schools from capital scheme number 32003/SCH/000

The Head of Engineering Services approved the extension of the Mobile Elevated Working Platforms Contract for a further 12 months in accordance with its terms and conditions.

The Head of Engineering Services:

i) approved the waiver of Contract Procedure Rule: 8 Between £10k and £100k Intermediate Value Procurement; and

ii) approved entering into a contract with Drakewell Computer Systems for continuing support of the C2 data system for a period of 4 years and extendable for a further 4 years.

The Acting Head of Transport Policy:

i) considered and overruled the objections to Speed Limit Order(s) 10, 15, 16 and 19 2013, and Section 90c Notice relating to the provision of traffic calming on Albert Road, Morley; Servia Hill, Little London; and Weetwood Lane, Weetwood; and

ii) requested the City Solicitor to inform the objectors accordingly.

The Head of Engineering Services:
i) noted the contents of the report; and

ii) approved the application from Leeds House, for a licence to operate a street café on the highway at Market Place, Otley LS21 3AQ ,as shown on the attached unnumbered drawing, to expire on the 31st March 2015 and that future licences be renewed annually, subject to satisfactory operation, and with approval from The Chief Officer (Highways and Transportation).

The Head of Engineering Services:
i) considered and over-ruled the objections received to the advertised draft Otley and Yeadon Traffic Regulation Order (Waiting Restrictions) (No.38) 2012;
ii) gave authority to make, seal and implement the Otley & Yeadon Traffic Regulation Order (Waiting Restrictions) Traffic Regulation Order (No.38) 2012 as advertised; and
iii) requested the City Solicitor to inform the objectors accordingly.

The Head of Engineering Services:

i) noted the principle of the highway works as outlined in Section 3.1 and indicated on drawings referenced: DC/SF/TDS00499/01 and land dedication plan DC/SF/TDS00499/02;
ii) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the Highways Act 1980, whereby the works associated with the development are carried out by this Council at the cost of the developer;
iii) gave authority to implement the works as set out in Section 3.1;
iv) approved an injection of £114,000 into the City Development Capital Programme, to be fully funded by the developer under a Section 278 agreement;
v) gave authority to incur expenditure of £114,000, being £95,000 works costs and £19,000 staff costs, to be fully funded by the developer under a Section 278 agreement;
vi) gave authority to advertise a notice under the provisions of Section 23 of the Road Traffic Regulation Act 1984 notifying of the proposed pedestrian crossing facilities;
vii) approved the proposed amendments to the existing waiting restrictions as described in 3.1.3 on Cudbear Street and Sheaf Street; and
viii) instructed the City Solicitor to advertise a draft Traffic Regulation Order, and, if no valid objections are received, to make, seal and implement the Order as advertised.

The Director of Environments and Housing agreed to approve the proposed first phase of the service restructure PO5 and above for Property and Contracts (Housing Leeds).

To seek approval for a contract variation for the removal of the Psycho-sexual counselling service valued at £148,676 from the Leeds and York Partnership NHS Foundation Trust from 1st April 2014. This is to enable Leeds Clinical Commissioning Groups to commission this service as part of their commissioning responsibilities from 1st April 2014 onwards.

In accordance with the delegation agreed at the meeting of the Executive Board on the 19th June 2013, the Deputy Chief Executive, the Director of City Development and the City Solicitor approved the terms of legal documents so as to provide assistance to GMV Twelve Limited to facilitate the delivery of the LRGP.
Executive Board at its meeting on the 19 June 2013 approved a report proposing that the Council provide support to the LRGP. It set out that the Council had been approached by CEG Ltd who are managing the development of the former Kirkstall Forge site on behalf of the owner of the site GMV Twelve Ltd to provide financial assistance to enable them to meet their planning obligations to contribute to the LGRP and to carry out associated highway infrastructure access works at the Kirkstall Forge Site. The report recognised that the proposed Kirkstall Forge Scheme (both the construction of the rail halt and the development of the adjoining land) is of strategic importance to the city and the city region and that there are sound economic reasons for the Council supporting GMV Twelve in meeting their obligations. That report also included agreed heads of terms, which provides for the Council's investment to be repaid in accordance with a schedule of repayments over a 10 year period to commence 6 months after the first sale of a residential property at the site, but no later than 1st April 2018.
The Deputy Chief Executive, the Director of City Development and the City Solicictor in taking their decision received a report setting out the terms of the legal agreement, Appendix A and B of this report are exempt from publication as they contains information relating to the financial and business affairs of GMV Twelve and the Council. The public interest in maintaining the exemption in relation to this matter outweighs the public interest in disclosing the information by reason of the fact that Appendix A and B contains information and financial details which, if disclosed, would adversely affect the business of the Council and GMV Twelve.

The Director of Property & Contracts Housing Leeds agreed to the award of the Domestic heating contract (Labour & Material) following a formal procurement exercise with the Efficiency North procure plus framework.
That similar service is provided by LCC’s ISP (enterprise Leeds) to the approximate value of £500k per annum under a Service Level Agreement.

The Chief Officer Property & Contracts Housing Leeds agreed to award a service provider to Supply and Maintain Fire Fighting Equipment (Hardware; Dry/Wet Risers and Automatic Sprinklers Systems) within the Social Housing Stock of Housing Leeds.

The Chief Officer of Property and Contracts agreed to declare Rycroft Primary School site surplus to Departmental requirements and granted approval to appropriate the site from the Department of Environment and Housing to the Department of Children’s Services

The Chief Officer of Property and Contracts agreed to declare 2 Autumn Terrace surplus to Departmental Requirements for the purpose of selling to Unipol on terms to be agreed by the Director of City Development.

The Director of Environment and Housing agreed to approve the report and the implementation of the proposed structure.

The Director of Environment and Housing agreed to approve the proposed phase 2 of the service restructure (PO5 and above) for Housing Management (Housing Leeds).

The Chief Officer CEL, approved the request to award the tender for the purchase of 36 replacement minibuses for Passsenger Transport as part of the 2014-15 replacement programme at a cost of 1.772m

The Director of Children’s Services agrees the allocation of £441,356 from the central budget to support schools in financial difficulty in accordance with the recommendations of the panel of the Leeds School’s Forum which was established to consider applications.

The Director of Children’s Services approved the creation of 50 additional childcare assistant’s posts at a number of Childrens Centres across the city to be deployed as required.

The Chief Officer (Highways and Transportation):
i) noted the contents of this report;

ii) approved the proposals to amend the existing Resident Permit scheme in the Saxton Gardens area and introduce waiting restrictions on Upper Accommodation Road and Lavender Walk as shown on attached Drawings TME/7/1/103/1 & 2, at a total cost of £6,000 funded by the elected members through injection into the Traffic Management Revenue budget; and

iii) Instructed the City Solicitor to advertise a draft Traffic Regulation Order and if no valid objections are received, to make, seal and implement the Order as advertised.

The Chief Officer (Highways and Transportation):
i) noted the contents of this report;

ii) approved the proposals to carry out a small element of kerbing/footway works and the introduction of Resident Permit Parking on Farm Road, Crossgates as shown on the attached drawing number. TME/20/1/93/1, at a total cost of £10,000 funded by the elected members through injection into the Traffic Management Revenue budget; and

iii) instructed the City Solicitor to advertise the draft Traffic Regulation Order to introduce residents only parking on a section of Farm Road, as shown on drawing number TME/20/1/93/1 and, if no valid objections are received, to make, seal and implement the Orders as advertised.

The Chief Officer (Highways and Transportation):
i) noted the contents of this report;

ii) approved the proposals to introduce waiting restrictions at six sites within the Wetherby ward as shown on drawing numbers TME/33/1/169/1 to 6, at a total cost of £6,000 funded from the Traffic Management Revenue budget; and

iii) Instructed the City Solicitor to advertise a draft Traffic Regulation Order to introduce various waiting restrictions and residents permit parking, as shown on drawing numbers TME/33/1/169/1 to 1 and, if no valid objections are received, to make, seal and implement the Order as advertised.

The Chief Officer (Highways and Transportation) approved the extension of the Water Features Maintenance Contract 2012/13 for a further 12 months in accordance with its terms and conditions

The Chief Officer (Highways and Transportation):
i) noted the contents of this report;

ii) approved the proposals to introduce waiting restrictions in the Chapel Allerton ward as shown on attached Dwgs TME/9/1/106/1 & 2, at a total cost of £5,000, comprising £1,000 works, £1,000 staff and £3,000 legal fees; and

iii) Instructed the City Solicitor to advertise a draft Traffic Regulation Order to introduce various waiting restrictions and a taxi rank for 4 taxis, as show on drawing numbers TME/9/1/106/1 & 2 and, if no valid objections are received, to make, seal and implement the Order as advertised.

The Chief Planning Officer has agreed that the above Tree Preservation Order will be confirmed as per the report of the City Solicitor (Corporate Governance)

Retrospective decision to invoke Contract Procedure Rule 21 and extend the existing contract with Capita (Contract number ICTSW100108) for an additional 12 months to 27th February 2015

The Chief Asset Management and Regeneration Officer is requested to give Authority to pend £151,388 towards the costs incurred in removing asbestos in readiness for the demolition of Holt Park Leisure Centre.

The Chief Asset Management and Regeneration Officer is requested to give Authority to Spend £110,110 in order to meet the contractualy obligation for the late handover of the Holt Park Leisure Centre.

That the Chief Officer Culture and Sport, with reference to Contract Procedure Rule 21.3, has approved Technogym to be identified as preferred bidder for this scheme and subsequently award the contract following successful expiry of the EU 10 day standstill period. Anticipated start date of the new contract April 1st 2014.

The Chief Officer Culture & Sport has approved the extension of contract LCC22990 for the provision of event stewarding & security for a further 2 x 12 month period

The Chief Planning Officer has:

i) Agreed the minor modifications to the CIL Draft Charging Schedule as set out in the Submission Version (Incorporating Modifications), in order to proceed with 4 weeks public consultation on the modifications

ii) Agreed for the Draft Charging Schedule Submission Version (Incorporating Modifications) and all associated evidence base and documents to be submitted to the Planning Inspectorate for subsequent examination, including the Council’s responses to the representations received on the Draft Charging Schedule.

iii) Noted that the following steps will be undertaken in order to deliver this decision:
a. The Draft Charging Schedule Submission Version (Incorporating Modifications) and Statement of Modifications will be published for public consultation. This material and all associated evidence base and documents will be submitted to the examiner along with any representations received on the Modifications. Following the examination and receipt of the inspector’s report and any further modifications required there would need to be a Full Council resolution to adopt the CIL.

b. The timescales for the implementation of this decision are that it is intended to submit the Schedule and commence the 4 weeks public consultation by the end of March 2014. The subsequent timetable will depend on the Core Strategy progress and capacity of the Planning Inspectorate.

c. The Chief Planning Officer is the officer responsible for implementation.
