In accordance with the delegation agreed at the meeting of the Executive Board on the 19th June 2013, the Deputy Chief Executive, the Director of City Development and the City Solicitor approved the terms of legal documents so as to provide assistance to GMV Twelve Limited to facilitate the delivery of the LRGP.
Executive Board at its meeting on the 19 June 2013 approved a report proposing that the Council provide support to the LRGP. It set out that the Council had been approached by CEG Ltd who are managing the development of the former Kirkstall Forge site on behalf of the owner of the site GMV Twelve Ltd to provide financial assistance to enable them to meet their planning obligations to contribute to the LGRP and to carry out associated highway infrastructure access works at the Kirkstall Forge Site. The report recognised that the proposed Kirkstall Forge Scheme (both the construction of the rail halt and the development of the adjoining land) is of strategic importance to the city and the city region and that there are sound economic reasons for the Council supporting GMV Twelve in meeting their obligations. That report also included agreed heads of terms, which provides for the Council's investment to be repaid in accordance with a schedule of repayments over a 10 year period to commence 6 months after the first sale of a residential property at the site, but no later than 1st April 2018.
The Deputy Chief Executive, the Director of City Development and the City Solicictor in taking their decision received a report setting out the terms of the legal agreement, Appendix A and B of this report are exempt from publication as they contains information relating to the financial and business affairs of GMV Twelve and the Council. The public interest in maintaining the exemption in relation to this matter outweighs the public interest in disclosing the information by reason of the fact that Appendix A and B contains information and financial details which, if disclosed, would adversely affect the business of the Council and GMV Twelve.

The Chief Planning Officer has:

i) Agreed the minor modifications to the CIL Draft Charging Schedule as set out in the Submission Version (Incorporating Modifications), in order to proceed with 4 weeks public consultation on the modifications

ii) Agreed for the Draft Charging Schedule Submission Version (Incorporating Modifications) and all associated evidence base and documents to be submitted to the Planning Inspectorate for subsequent examination, including the Council’s responses to the representations received on the Draft Charging Schedule.

iii) Noted that the following steps will be undertaken in order to deliver this decision:
a. The Draft Charging Schedule Submission Version (Incorporating Modifications) and Statement of Modifications will be published for public consultation. This material and all associated evidence base and documents will be submitted to the examiner along with any representations received on the Modifications. Following the examination and receipt of the inspector’s report and any further modifications required there would need to be a Full Council resolution to adopt the CIL.

b. The timescales for the implementation of this decision are that it is intended to submit the Schedule and commence the 4 weeks public consultation by the end of March 2014. The subsequent timetable will depend on the Core Strategy progress and capacity of the Planning Inspectorate.

c. The Chief Planning Officer is the officer responsible for implementation.

To approve capital expenditure of £3.1M on essential corporate ICT software upgrades for 2014/15.  This principally incorporates important elements of software e.g. old and unsupported desktop software, website and intranet development, central server software upgrades, essential development and testing tools, mobile device management and security. This includes the human resources effort to install and commission.

The Deputy Chief Executive has given approval to incur capital expenditure of £3.1M on essential corporate ICT software upgrades for 2014/15.  Microsoft Office Communicator will be upgraded from v2007 to MS Lync 2013. Important Website and Intranet developments. Upgrade MS Windows Server and MS SQL Server to v2012. Oracle upgrade to v.11g.  Upgrade general software e.g. MS Internet Explorer, Adobe Reader, Visio, MS Project.  Develop a Windows 8.1 image for trial on tablet devices and mobile phones.  Upgrade the core software used to develop and support our internal systems i.e. MS Team Foundation Server, Application Lifecycle Manager, Web Development Tools, Visual Studio 2013. Smartphone and ‘Bring Your Own Device’ device software management will also be upgraded.  Important IT Testing tools will be introduced.  This involves the engagement of internal and external resources and the associated project management to implement this business critical software.

The Deputy Chief Executive has given approval to incur capital expenditure of £1.1M on essential corporate ICT hardware upgrades for 2014/15.  This principally incorporates the replacement of some of our aging Cisco network switches and refreshing elements of our MS Windows virtual server farm.  Decommissioning the 3rd floor Civic datacentre and refreshing old end of life ‘end user’ devices.  This programme involves the engagement of internal and external resources and the associated project management to implement this business critical hardware.
