The Director of Environment and Housing approved changes to the structure of the Environmental Health Service

The Chief Officer (Highways and Transportation):

i) authorised, subject to public consultation and the WBI funding confirmation, the detailed design and implementation of a scheme to introduce a 20 mph zone, including traffic calming features on Coppice Wood Avenue, in the Coppice Wood area of Otley and Yeadon / Guiseley and Rawdon.

ii) gave authority to advertise a Notice for the road humps that conforms with the Highways Act 1980 (90c Notice);

iii) Instructed the City Solicitor to:
a) advertise a draft Speed Limit Order, to introduce a 20 mph zone in the Coppice Wood area of Otley and Yeadon / Guiseley and Rawdon, as shown on drawing TMW/27/1952/HB;

b) advertise a draft Traffic Regulation Order to introduce a formal restriction, subject to consultation with the individual school, on the existing school keep clear markings outside of Queensway Primary School as shown on drawing TMW/27/1952/HB and, if no valid objections are received to make and seal the orders and implement the traffic calming proposals as advertised .

The Chief Officer (Highways and Transportation):

i) noted the contents of this report;
ii) approved the proposals at the total cost of £216,000; and
iii) gave authority to incur expenditure of £202,000 works costs and £14,000 staff costs, to be funded from the LTP Transport Policy Capital Programme.

The Chief Officer (Highways and Transportation):

i) noted the highway works as outlined in Section 3.1 and indicated on drawing reference: T198E-9000 Rev D;

ii) gave authority to negotiate the terms of and enter into a minor agreement with the developer under the provisions of Section 278 of the Highways Act 1980, whereby the works associated with the development are carried out by the Developer at the full cost of the developer, and the design checked and construction inspected by the Council (with the power to intervene if necessary);

iii) gave authority to implement the works as set out in Section 3.1;

iv) approved an injection of £16,000 into the City Development Department Capital Programme comprising £10,000 staff fees to check and inspect the highway works, and £6,000 to prepare, advertise, make and seal the TRO, all to be fully funded by the developer;

v) gave authority to incur expenditure of £10,000 staff costs and £6,000 legal costs, all to be fully rechargeable to the developer from a Section 278 agreement;

vi) instructed the City Solicitor to draft and advertise two TROS (Traffic Regulation Orders) for the introduction of No Waiting at Any Time and loading restrictions and the prohibition of motor vehicles (no left turn) except for cycles restriction as indicated on drawing no. T198E-9000 Rev D and if no valid objections are received to make, seal and implement the Orders as advertised; and

vii) gave authority to increase the adopted highway boundary area to that shown on drawing ref. T198E-9000 Rev D.

The Chief Officer (Highways and Transportation):

i) noted the highway works as outlined in Section 3.1 and indicated on drawing reference: E06/4165/043C;
ii) gave authority to negotiate the terms of and enter into a minor agreement with the developer under the provisions of Section 278 of the Highways Act 1980, whereby the works associated with the development are carried out by the Developer at the full cost of the developer, and the design checked and construction inspected by the Council (with the power to intervene if necessary);
iii) gave authority to implement the works as set out in Section 3.1;

E06/4165/043C and if no valid objections are received to make, seal and implement the Orders as advertised; and advertise a notice under Section 90c of the Highways Act 1980 to provide traffic calming measures as shown on the drawing nnumber. E06/4165/043C and if no valid objections are received, to introduce the traffic calming measures as advertisedgave authority to increase the adopted highway boundary area to that shown on drawing ref. E06/4165/043C and for this area to be fully recorded in the Council’s adopted highway registry.

The Chief Officer (Highways and Transportation):

i) gave authority to incur expenditure of £38,000, funded from the LTP Transport Policy Capital Programme;
ii) approved the utilisation of the Loop Cutting Contract for works covered in the framework contract; and
iii) approved the invitation of quotations for the remaining works in accordance with CPR 7.1 Low Value Procurement

The Diretor of City Development has given approvel to the disposal of St. Chad's C of E Primary School playing field to Abbey Academies Trust enabling it to run the school as an academy school on a 125 year lease at nil consideration in line with legislation and on the terms outlined within this report.

The Director of Children's Services agreed to:
- approve the request to award the contract in the sum of £2,637,334.35 to Infrastructure Managers Ltd the SPV to construct a modular building for the Basic Need new build expansion of Asquith Primary School.
- authorise the signature of the deed of variation of the Project Agreement required to implement the scheme.
- autohrise the signature of the independent certifiers' deed of appointment and collateral warranties with the main building contractor, architect, landscape architect, employers agent, mechanical and electrical engineer and structural engineer.
- authorise the signature of all other documentation that is required to deliver the project in the opinion of the Programme Manager Built Environment.

That the Head of Forward Planning and Implementation approved:
• Approved the expenditure of £58,333.53 S106 green space monies on improvements to Beckett Park, Weetwood.

The Director of Environment and Housing has declared land surplus at Cromwell Street and Naseby View to enable its inclusion in the adopted highway associated with road and footpath improvements to be undertaken as part of the redevelopment of the adjoining former Agnes Stewart High School.

The Chief Planning Officer has:
• authorised the designation of Headingley Neighbourhood Area (as shown on Plan) pursuant to Section 61G and 61I of the Town and Country Planning Act 1990
• authorised the designation of the Headingley Neighbourhood Forum pursuant to Section 61F (5) of the Town and Country Planning Act 1990.

The Director of Environment and Housing agreed to
1.Instruct officers to instigate Compulsory Purchase Order action under the provisions of Part II and Section 17 of the Housing Act 1985 against the premises known as 43 Nowell Place Harehills Leeds LS9 6HT.

2.Subject to the confirmation of the order. The property will be disposed of in line with the previously agreed disposal mechanism for properties obtained through Compulsory Purchase (Appendix 6).

3.Authorise the allocation of funds from the Leeds Neighbourhood Funds to meet any claims by the title holder of the property that may arise subsequently.
4.Authorise the City Solicitor to prepare a Compulsory Purchase Order under the provisions of Part II and Section 17 of the Housing Act 1985, and that the Common Seal of the Council be affixed thereto and to the Order Map and that the City Solicitor, be further authorised to make application to the Department of Communities and Local Government for confirmation of the Order.

The Director of Environment and Housing agreed to approve the write off irrecoverable Former Tenants Arrears in the sum of £68652.30 represented by 157 accounts.

The Director of Environments and Housing agreed to approve the following recommendations:
• Increase resources within the Adaptations Team located within Property and Contracts to support the planning and surveying of private sector adaptation work.
• Create a single delivery vehicle for the installation of general adaptations using the internal service provider for adaptation work such bathing adaptations, ramps, internal configuration, kitchen adaptations etc. and some extension work.
• Approve a start date of the 1 April 2015 for the new delivery process to commence.

Transfer of posts relating to the adaptations needs assessment function from Property and Contracts to Strategic Housing.

The Chief Asset Management and Regeneration Officer has given approval to declare land at Wakefield Road, Oulton, surplus to the Council’s requirements and to approve terms, as outlined in the confidential appendix of this report, for its sale on a one to one basis to the adjoining landowner.

The Chief Asset Management and Regeneration Officer recommended that approval is given to the terms upon which the Council will acquire the freehold of this house.

The Head of Land and Property has approve the sale of the land as outlined on the accompanying appendix.

The Director of Environment and Housing is requested to approve standardisation of the fees and charges as detailed in Table 1, paragraph 3.2 of the report..

Transfer of the housing needs assessment function from Housing Leeds – Housing Management to Housing Leeds – Strategic Housing

The Director is requested to refuse the application to repurchase the property.

The Council’s strategy for procurement, through an Officer Delegation Scheme, gas was approved in January 2013. In order for LCC to be able to put in place a contract in a suitable time frame, permission to procure must now be granted.

• The Director of Adult Social Services approved an extension of the contract with Housing 21for the provision of the CEP scheme for twelve months from 1st November 2014 under CPR 21.1, as per the terms of the contract. The contract value is £135,000 per annum.
• The Director of Adult Social Services also approved that the budget for emergency care hours is increased to £15,000 from within the carers budget.

The Chief Asset Management & Regeneration Officer gave authority to spend £64,100 for the refurbishment of Bellbrook car park and Bellbrook street barrier. This is a sub-scheme under Harehills Town and District Centre 2 project. The detailed design and justification is provided in the Design and Cost report attached.

The Chief Economic Development Officer has noted the content of the report in consultation with the Executive Member for Transport and the Economy.

The Chief Officer Employment and Skills has noted the content of the report in consultation with the Executive Member for Creative and Digital Technologies, Culture and Skills

The Chief Officer Property and Contracts agrees to the preferred option of selling 258 Lidgett Lane on the open market on terms agreed by the Director of City Development

The Head of Governance Services has approved the transfer of the records listed in the attached schedule (Appendix A to the attached report) to the West Yorkshire Archive Service. The Head of Governance Services has the authority to approve the transfer of these documents through the sub-delegation scheme of the City Solicitor. The scheme gives the Head of Governance Services delegated authority for the management of corporate governance. This function is one of the specific delegations to the City Solicitor under the Executive delegation scheme within Part 3 Section 3E of the Council’s Constitution.

This transfer will take place on 21st October 2014, and is being made in accordance with the Governance Services document retention and disposal arrangements.

The Director of City Development has approved a payment of £238,093 in full and final settlement of the costs to the Society of providing a visitor centre building and car park and associated works, fittings and fixtures at the St. Aidan’s site.

The Chief Officer of Environmental Action Services agreed to approve the invocation of the following Contracts Procedure Rule:
• Contracts Procedure Rule No 31.3 – Waiver of Contracts’ Procedure Rules

The Chief Officer (Highways and Transportation):

i) authorised public consultation and discussion with commercial properties;

ii) authorised the detailed design and subsequent implementation of a scheme in the Guiseley and Rawdon Ward, as shown on drawing TMW15-3-1987_01d, to introduce a series of pedestrian infrastructure improvements around the A65 Otley Road/ Oxford Road/ Victoria Road junction, including new formal signalised facilities on Oxford Road and a new zebra crossing facility on Victoria Road; and

iii) gave authority to incur expenditure of £144,700 being £116,000 works costs and £28,700 staff fee costs, with £100,000 funded from the LTP transport policy capital programme and £44,700 funded from Section 106 monies.

iv) gave authority to display a Notice on site under the provisions of Section 23 of the Road Traffic Regulation Act 1984 to inform the public of the proposed zebra crossing

The Chief Officer (Highways and Transportation):

ii) gave authority to negotiate the terms of and enter into an agreement with Bradford Metropolitan District Council under the provisions of Section 8 of the Highways Act 1980, to allow any necessary improvements to specified highways to facilitate construction of the cycle superhighway as shown on drawing Nos EP-716969-100-A-001b, EP-716969-100-A-002a, EP-716969-100-A-003a, EP-716969-100-A-004a, EP-716969-100-A-005a, EP-716969-100-A-006a, EP-716969-100-A-007a, EP-716969-100-A-008a, EP-716969-100-A-009a, EP-716969-100-A-010a and EP-716969-100-A-011a; and

iii)Instructed the City Solicitor to draft and complete an agreement under Section 8 of the Highways Act 1980 for the purposes described at ii) above.

The Chief Officer (Highways and Transportation) approved the waiver of Contract Procedure Rule 8.1 and 8.2 – Intermediate Value Procurements – and to carry out a single tender action with Meteo Group for Winter Road Weather Forecast Contract 2014 – 2015 for Leeds City Council.

The Chief Officer (Highways and Transportation):

i) approved, subject to public consultation, the detailed design and implementation of a scheme to introduce a humped zebra crossing facility on Butcher Hill, Kirkstall, as shown on drawing number TMW/22/1963/1 at an estimated cost of £25,000;

ii) requested the City Solicitor to advertise a Notice for the humped zebra crossing traffic calming measure on Butcher Hill, Kirkstall as shown on drawing TMW/22/1963/1 and if no valid objections are received to implement the proposals as advertised;

iii) gave authority to advertise a Notice for the road hump that conforms with the Highways Act 1980 (90c Notice); and

iv) gave authority to incur expenditure of £18,000 works costs and £7,000 staff design fee costs, to be part funded from a Section 106 receipt £10,000 and also from the LTP Transport Policy Capital Programme £15,000.

The Chief Officer (Highways and Transportation):

i) authorised, subject to public consultation, the detailed design and implementation of a scheme to introduce a 20 mph zone in the Winrose area of Middleton as shown on drawing number TMW/23/1983/1

ii) requested the City Solicitor to:

a) advertise a draft Speed Limit Order, to introduce a 20 mph zone in the Winrose area of Middleton, as shown on drawing TMW/23/1983/1; and

b) to seek approval to advertise a draft Speed Limit Order and Section 90C Notice

iii) gave authority to incur expenditure of £18,000, which comprises of £12,000 works costs, £4,000 Staff fees and £2,000 legal fees, all to be funded from the LTP Transport Policy Capital Programme.

The Chief Officer (Highways and Transportation):

i) authorised, subject to public consultation, the detailed design and implementation of a scheme to introduce a 20 mph zone in the Belle Isle East area of Middleton as shown on drawing number TMW/23/1982/1;

ii) requested the City Solicitor to advertise a draft Speed Limit Order, to introduce a 20 mph zone in the Belle Isle East area of Middleton, as shown on drawing TMW/23/1982/1 and if no valid objections are received to make, seal and implement the Orders as advertised ; and

iii) gave authority to incur expenditure of £18,000, which comprises of £12,000 works costs, £4,000 Staff fees and £2,000 legal fees, all to be funded from the LTP Transport Policy Capital Programme.

The Director of Environments and Housing agreed to the approval of amendments to the Environment and Housings Sub-delegation Scheme the amendments in appendix one to this attached Report.

The Director of Environments and Housing agreed to the amendments stated initem 1 of this report to ensure smooth transition for the continuity of the rent arrears process thereby reducing the risk to the process.
