The Deputy Chief Executive approved the one year contract extension for the supply of individual frozen meals and regeneration vehicles Apetito

The Acting Head of Transport Policy:
i) noted the contents of this report;
ii) approved the detailed design and implementation of a scheme to remove the existing traffic calming features on Foundry Lane, Seacroft, between Wykebeck Valley Road and the A64 York Road, as shown on the attached drawing number TM_E/20.2/7-4 and replace them with a more appropriate system;
iii) gave authority to incur expenditure of £75,000 comprising £60,000 works costs and, £15,000 staff costs funded from the LTP Transport Policy Capital Programme; and, if no valid objections are received, to implement the proposals as advertised;
iv) instructed the City Solicitor to draft, advertise and arrange to display on site a Notice under the provisions of Section 90C of the Highways Act 1980 for the traffic calming proposals, as show on drawing number TM_E/20.2/7-41. and, if no valid objections are received, to implement the proposals as advertised.

The Chief Officer for Civic Enterprise Leeds has approved the award of the Phase I of the subcontractor framework contracts nominated contractors named in the DDN report. The contract will run for three years from 1st February 2015.

To approve the incurring of expenditure of £90,177 to secure planning approval for Elmete Cemetery including Phase One ground ancillary works.

The Director of City Development has approved:
(i) A 20% reduction in base rent for all open market traders who have a regular licence to occupy premises on Kirkgate Open Market as at 1 January 2015. The scheme to run for one year until 31 December 2015;
(ii) An allocation of £120,000 in respect of the financial assistance to Kirkgate Open Market.

The Chief Officer, Access & Care, approved the contents of a report regarding a care plan in respect of a person with complex care needs, the individual cost of which is £153,400 per annum.
It is considered in the public interest that information contained in the report is exempt from publication as it relates to a vulnerable citizen of the City and the actions being taken to enable that person to live independently in a safe environment.

The Chief Officer (Highways and Transportation):
i) considered and overruled the objections to the scheme;
ii) gave authority to implement the scheme as shown on the attached plan TMW.18.2.1964c; and
iii) requested the City Solicitor to make, seal and implement Leeds City Council (Speed Limit) Order 21 2014 as advertised and inform the objectors accordingly of the Chief Officer (Highways and Transportation’s) decision.

The Chief Officer (Highways and Transportation):
i) considered and overruled the objections to the scheme;
ii) gave authority to implement the scheme as shown on the attached plan TMW.18.2.1964c; and
iii) requested the City Solicitor to make, seal and implement Leeds City Council (Speed Limit) Order 21 2014 as advertised and inform the objectors accordingly of the Chief Officer (Highways and Transportation’s) decision.

The Chief Officer (Highways and Transportation):

i) Considered the objection to the advertised Leeds City Council (Waiting Restrictions) No.26 Order 2013, Amendment Order No.1 2014, (as shown in the attached drawing TMW-18-1223-1) and the officer’s comment provided;

ii) Overruled the objection and give authority to implement the scheme as advertised; and

Requested the City Solicitor to make, seal and implement Leeds City Council (Waiting Restrictions) No.26 Order 2013, Amendment Order No.1 2014 as advertised and inform the objector accordingly of the Chief Officer (Highways and Transportation’s) decision.

The Chief Officer (Highways and Transportation):

i) Considered and overruled the objections to Leeds City Council (Speed Limit) Order 23 2014; and

ii) requested the City Solicitor to make, seal and implement Leeds City Council (Speed Limit) Order 23 2014 as advertised and inform the objector accordingly of the Chief Officer (Highways and Transportation’s) decision.

The Chief Officer (Highways and Transportation) instructed the City Solicitor to affix the Common Seal of the Council to the Agreement to be entered into under the provisions of Section 274/278 of the Highways Act 1980 to allow the Highways Agency to proceed with the works

The Chief Officer (Highways and Transportation):

i) noted the contents of this report;

ii) approved the proposals to install two Resident Parking Only signs and introduce Resident Permit Parking on Kirkstal Road/Woodside View, as shown on the attached Drawing No. HDC/713184/MISC/181, at a total cost of £6,500 funded from the A65 Quality Bus Scheme budget; and

iii) authorised the City Solicitor to advertise the draft Traffic Regulation Order and, if no valid objections are received, to make, seal and implement the Orders as advertised.

The Chief Officer, Parks and Countryside has agreed to a recommendation from the Business Development Manager, Parks and Countryside to award a contract for weed spraying services to Languard Ltd
Appendix A to this report has been marked as confidential under Access to Information Procedure Rules 10.4 (3) on the basis that it contains information relating to the financial or business affairs of any particular person (including the authority holding that information) which, if disclosed to the public, would, or would be likely to prejudice the commercial interests of that person or of the Council.

The Chief Officer (Highways and Transportation):

i) noted and approved the contents of this report;
ii) authorised the charges increase under the development agreement dated 28 March 2014 between the Council QHD and Caddick; and
iii) instructed the City Solicitor to vary the charges to the Quarry Hill Car Park by notice under section 35C of the Road Traffic Regulation Act 1984 to those listed in paragraph 3.3.

The Chief Officer (Highways and Transportation):

i) noted the contents of this report;

ii) approved the detailed design and implementation of the scheme to introduce No Waiting At Any time restrictions on Cross Green Court and Cross Green Vale, at a cost of £5,000 funded by contributions from local business; and

iii) instructed the City Solicitor to advertise a draft Traffic Regulation Order to introduce No Waiting At Any Time restrictions as shown on drawing number TM-E-7-1_111-01 and if no valid objections are received, to make, seal and implement the Order as advertised.

The Acting Head of Transport Policy authorised:

i) Waive Contract Procedure Rule 8.1 and 8.2 – Intermediate Value Procurements – and approve entering into a contract with Cycle Leeds for the Bikeability Cycle Training Contract from 1st April 2015 to 31st July 2015 for Leeds City Council without seeking competition.

The Chief Officer (Highways and Transportation):

i) noted the contents of this report;

ii) approved the proposal at the total cost of £15,000; and

iii) gave authority to incur expenditure of £12,000 works costs and £3,000 staff costs, to be funded from the WYCA Bus hotspot fund (LTP Transport Policy Capital Programme).

The Chief Officer (Highways and Transportation):

i) Considered the objections to the advertised Leeds City Council (Waiting Restrictions) No.26 Order 2013, Amendment Order No.2 2014, (as shown in the attached drawing TMW-18-1225-1c) and the officer’s comments provided;

ii) Overruled the objections and give authority to implement the scheme including the amendments as in drawing TMW-18-1225-1c; and

iii) Requested the City Solicitor to amend, make, seal and implement Leeds City Council (Waiting Restrictions) No.26 Order 2013, Amendment Order No.2 2014 as in drawing TMW-18-1225-1c and inform the objectors accordingly of the Chief Officer (Highways and Transportation’s) decision.

The Chief Officer Parks and Countryside approves the injection of £76k into the capital programme and authorises the expenditure of £76k on the delivery of a skateboard park in Middleton

The Chief Officer (Highways and Transportation):

i) approved the contents of the report;
ii) gave authority to advertise notices under Section 90C of the Highways Act 1980 and Section 23 of the Road Traffic Regulation Act 1984, to create vertical traffic calming features and new pedestrian crossings respectively at locations shown on the attached drawings (716969-B-001B-SU1 to 716969-G-11-SU38 (excluding dwgs 7169690-F-001-SU21 to 716969-F-007-SU27); and
iii) approved with reference to the powers contained in Section 66(4) of the Highways Act 1980, that the relevant lengths of footway shown on attached drawings (716969-B-001B-SU1 to 716969-G-11-SU38 (excluding dwgs 7169690-F-001-SU21 to 716969-F-007-SU27) as proposed cycle tracks are removed and that following the removal of the footways, cycle tracks are constructed under the powers contained under the provisions of section 65(1) of the Highways Act 1980 for shared joint use by pedal cyclists and pedestrians.

The Acting Head of Transport Policy:

i) approved the proposed restrictions detailed in this report; and

ii) instructed the City Solicitor to advertise a draft Traffic Regulation Order, briefly comprising

a) Parking and loading restrictions as shown on drawing numbers EP-716969-TRO-091/092/093/094/095/096/097/098

b) Mandatory cycle lanes as shown on drawing numbers EP-716969-TRO-091/092/093/094/095/096/097/098

The Director approves:
1. the terms (and implementation) of settlement of the Disputes (as more particularly set out in the related decision report); and
2. the terms (and implementation) of the related contract variations (as more particularly set out in the related decision report).
The decisions will realise savings of over £250k and it is also considered that the decision should be published in the interest of ensuring accountability and transparency, but (in accordance with Article 13) it is not considered a key decision as:
a) the settlement is a reconciliation of normal invoicing processes within the Street Lighting PFI Scheme and the variation is an operational change in accordance with the contract terms (i.e. these are decisions which are a direct consequence of implementing a previous key decision); and
b) the payment resolves a long standing dispute with the contractor (i.e. is in settlement of proceedings to which the Council is a party).

The Director of City Development gave Authority to Spend £148,000 to undertake urgent repairs to the roof above the Victoria Hall of Leeds Town Hall.

The Head of Licensing and Registration approved the introduction of an annual on-line DBS Status check for licensed hackney carriage and private hire drivers, which provides financial benefit to licence holders and increased access to notifiable information for licensing Officers, as recommended by Licensing Committee at its meeting on 9 December 2014

The Director of City Development authorised expenditure up to £175,000 for the relocation of the Aireborough One Stop Centre from Micklefield House Rawdon to Yeadon Library, and associated expenditure to adapt the library to accommodate this function.

To request the waiver of Contracts Procedure Rules (CPR) 9.1 and 9.2 in order for Leeds City Council to enter into a contract with Health for All for a period of 24 months to deliver a Holistic Community Health and Wellbeing Service.
The overall budget for the programme is £248,000, and this is funded by the Leeds South and East CCG. This funding will be used to provide training for staff to deliver the sessions to individuals, provision of 1:1 sessions in a variety of community buildings / GP Practices which aim to improve the overall health & wellbeing and marketing of this service to GP Practices / the local community.
