The existing Enhanced Sexual Health Pharmacy
Scheme contract expires on March 31st 2017. A subcontracting
arrangement had been developed for the transfer of commissioning
responsibility to the provider of the Integrated Sexual Health
Services provided by Leeds Community Healthcare NHS Trust (LCH).
This was due to happen on 1st April 2017. However, during
negotiations between Leeds City Council and Leeds Community
Healthcare NHS Trust it became clear that LCH need longer to be
able to accept the transfer. Jointly LCC and LCH have agreed a
revised timeline would be in the interest of the service with the
aim of transferring the service in April 2018.
The award of new 1 year interim contracts is the only option to
prevent service disruption as there are no further contract
extensions available on the existing contracts and the
Council’s negotiations for novating the contracts over to
Leeds Community Healthcare Trust have been disrupted.
The Enhanced Sexual Health Pharmacy Scheme comprises
• 38 pharmacies based on areas of need (Pharmacy needs
assessment)
• Annual budget for payments is £60K
• An additional £3000 is spent on resources (Chlamydia/
Gonorrhoea
postal kits, pregnancy tests, condoms).
This request to directly enter into interim contracts with existing
pharmacy
providers of this service for 1 year from 1st April 2017 is in
accordance with Contracts Procedure Rules 8.1 and 8.2.

Following consideration of this matter by
Licensing Committee on 7th October 2014 (report attached) further
legal advice was sought to support the existing position on the
Immediate Suspensions policy. After a significant delay, that
advice has now been received.
‘The making of a second decision, following an immediate
suspension, (that is to revoke) is not adversely effected in the
policy by the interpretation applied in the case of R. (on the
application of Singh and others) v.Cardiff City Council [2012] EHWC
1852 (Admin) and the legal advice, prepared by separate Counsel,
support both the ‘Policy on Immediate Suspension and
Revocation Decisions’ in its original and present form in
respect of the legality of making a second decision, and, as a
consequence, the existing ‘Plying for Hire
Policy’.
With this in mind the Head of Elections, Licensing and Registration
has now approved the recommended amendment to the plying for hire
policy:
‘That on the second conviction, or caution, for plying for
hire that the existing threshold of 3 years before the grant of a
licence would be considered, be extended to 4 years.’

1. Instruct officers to instigate Compulsory Purchase Order action
under the provisions of Part II and Section 17 of the Housing Act
1985 against the premises known as 19 Brayton Place, Whinmoor,
Leeds LS14 5BB. Subject to the confirmation of the order, the
property will come into the ownership of Leeds City Council and
will be subsequently disposed in accordance with the agreed
disposal mechanism for properties acquired through Compulsory
Purchase.
2. Subject to the confirmation of the order, the subsequent sale of
the property could be either to a Registered Social Provider, to
the private sector or retained by the Council. The property will be
disposed in line with the previously agreed disposal mechanism for
properties obtained through compulsory purchase (Appendix 6).
3. Authorise the allocation of funds from the Leeds Neighbourhood
Approach approved fund to meet any claim for compensation that may
arise subsequently from a claim by the title holder of the
property.
4. Authorise the City Solicitor to prepare a Compulsory Purchase
Order under the provisions of Part II and Section 17 of the Housing
Act 1985, and that the Common Seal of the Council be affixed
thereto and to the Order Map and that the City Solicitor, be
further authorised to make application to the Department of
Communities and Local Government for confirmation of the
Order.
