To receive and consider the attached report of the Chief Planning Officer regarding an ap-plication for reserved matters approval in relation to appearance, landscaping, layout, scale and access pursuant to planning permission 22/03514/FU for the construction of three buildings comprising apartments and ancillary space, commercial units and landscaping.

Further to the minutes of the previous City Plans Panel meeting held on Thursday, 12th September 2024, members considered the report of the Chief Planning Officer which presented proposals for matters in relation to appearance, landscaping, layout, scale, and access pursuant to planning permission 22/03514/FU for the construction of three buildings comprising apartments and ancillary space, commercial units, and landscaping at 71 - 73 Mabgate, Sheepscar, LS9 7DR.

 

The report included further information on the proposed content of the welcome pack that would be provided to future residents and further information on how any noise complaints would be dealt with by the Council as requested at the 12th September 2024 City Plans Panel meeting. The report  recommended to the Panel that the applications be deferred and delegated to the Chief Planning Officer for Reserved Matters approval, subject to conditions, as set out in the submitted report and appendices.

 

Supplementary information was published on the council’s website and distributed to members in respect of additional representations received.

 

Slides and photographs of the site and proposals were presented by the Planning Officer who outlined the additional details relating to the proposed welcome pack and the process for addressing any noise complaints.

 

It was noted that since publication of the submitted report, a further letter of objection and a signed petition was received. Both of which did not raise any new material considerations that haven’t already been addressed in the submitted report.

 

Questions and comments from Panel Members then followed, with officers responding to the questions raised, which included the following:

·  Confirmation that occupiers will receive a welcome pack when they take up occupancy and prospective residents will be made aware of the nature of events at MAP prior to taking up occupancy. Additionally, it was noted that the full details of the welcome pack including arrangements relating to the residents information app  will have to be agreed by the Local Planning Authority prior to occupation of the development.

·  Clarity on the legal interpretation of statutory nuisance under the Environmental Protection Act 1990

·  Confirmation that any future who owner of the proposed development wanting to utilise the planning permission  , will be bound by the same planning conditions (including the one relating to the welcome pack)

·  Panel Members are satisfied with the further information provided regarding the residents welcome pack and arrangements for addressing any noise complaints.

 

Upon voting, a motion was put forward to move the officer recommendations, as per the submitted report. This was moved and seconded, and it was unanimously

RESOLVED – That the application be deferred and delegated to the Chief Planning Officer for approval, subject to the conditions as contained in the submitted report and Appendix 1.
