The application was previously presented at the South and West Plans Panel meeting held on Thursday, 3rd August 2023. Members deferred the application to enable information to be provided by an objector who lives in close proximity of the site, and who disclosed private information during a closed session of the meeting. However, such information has not been provided to the local planning authority.
The Area Planning Manager explained that Sport England submitted a late representation which is a material consideration regarding the loss of the grass running track. It is confirmed that they have no further objection subject to a planning condition being added regarding the addition of a 3 lane fully synthetic track as a result of the loss of the grass running track. Further to this the following issue has been identified: - · This is a new material consideration to the application which has been raised by Sport England and therefore, the application requires further consideration as it cannot be covered by a condition as it does not meet the legal tests. Officers therefore proposed an amended recommendation to defer the application at this time.
A member suggested that an alternative motion be proposed in that best endeavours are made in seeking the information from the objector, so that members are provided with the opportunity to have due regard to the equalities act. Officers explained that 3 attempts have been made to seek such information from the objector and has been unsuccessful. It was confirmed that best endeavours will be made to obtain the information, subject to Access to Information Procedure Rules.
Members expressed their concern and disappointment regarding the very late submission from Sport England and acknowledged officers and members time in attending the meeting.
A motion was put forward to defer the application, as well as best endeavours being made by officers to obtain information by the objector who disclosed information in a closed sessions of the South and West Plans Panel meeting on Thursday, 3rd August 2023. The motion was moved and seconded, and therefore it was unanimously RESOLVED – To defer the application to consider the new material consideration as a result of Sport England’ representation as well as best endeavours being made by officers to obtain information from the objector.
