Decision to implement the following joint contracting arrangement with Leeds NHS Clinical Commissioning Group (the CCG)  for the commissioning and delivery of a pilot 10-bedded care home service for people with dementia and complex needs at the Recovery Hub @South Leeds:

-  Enter into an agreement with the CCG to pool previously approved LCC funding and re-designated CCG funding in the Better Care Fund Section 75 Agreement with Leeds CCG (total value £1.78M over 2 years) – for the service.

-  Funding approved in Budget 2020-21 full council meeting mins - page 127, appendix 8, section 3.10.2…£668k is to be invested in a dementia strategy including the development of a dementia unit within the South Recovery Hub for people with high support needs. Financial contributions of £300k from the CCG and a transfer from existing residential care provision will mean a net increased cost to the Council for this much needed development of £150k.

-  To note additional funding requirement of £368k per annum for two years and to approve LCC funding to the value of £184k per annum for two years, as 50% contribution towards this additional cost. 

-  Establish the grounds for LCC to deliver the care home service (delivered in partnership with Leeds NHS Community Healthcare Trust (LCH)).

-  Establish the contracting model for the delivery partnership with LCH and seek approval to enter into negotiation with LCH with a view to contracting with them.

Financial and Procurement Implications -

The decision involves the pooling of £704,000 Leeds CCG funding per annum plus a further £184,000 per annum (total £888,000 per annum) within the Better Care Fund Section 75 Partnership Agreement for an initial period of two years (total £1.78M over 2 years).

The report will set out the case, from a procurement perspective, for LCC being the nominated lead service provider and for entering into a partnership with LCH for the delivery of nursing and physiotherapy services.

Partnership Working –

A parallel decision is required via Leeds CCG governance to enter into this arrangement and to sign off changes to the BCF section 75 agreement via the Integrated Commissioning Executive governance.

The proposal (but not the decision) is dependent on LCH agreeing to enter into the partnership delivery arrangement.

This proposal is being developed in close co-operation with both of these partner organisations.

The Director of Adults and Health recommended the following:

1.  To enter into an agreement with the CCG to pool previously approved LCC funding and re-designated CCG funding in the Better Care Fund Section 75 Agreement with Leeds CCG (total pooled value £1.883m over 2 years) – for the service.

2.  To use Adults and Health in-house provision to undertake the care and support service requirements to the value of £1.315m to establish LCC to be the lead provider of the service

3.  To approve the use of the negotiated procedure without prior publication of a notice under Regulation 32 (2) (b) (ii) of the Public Contracts Regulations 2015, for an initial period of 2 years at a total value of £465,000, resulting in the award of a contract to Leeds Community Healthcare Trust to deliver nursing and physiotherapy services.
