To seek nominations for the election for the position of Chair.

RESOLVED – To elect Councillor Hutchison as Chair for the duration of the hearing.

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance and Scrutiny Support at least 24 hours before the meeting)

There were no appeals against refusal.

1)  To highlight reports or appendices which:

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

c)  If so, to formally pass the following resolution:-

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

There were no exempt items.

There were no formal late items.

To consider a report by the Chief Officer, Elections and Regulatory which sets out details of an application which seeks the Grant of a Premises Licence for The Yard, Building And Yard Rear, 11A Main Street, Garforth, Leeds,

LS25 1DS.

The report of the Chief Officer Elections and Regulatory sets out an application for the grant of a premises licence for The Yard, Building and Yard Rear, 11A Main Street, Garforth, Leeds, LS25 1DS.

The following were in attendance for this application:

·  Mr Iain Whipp – Proposed Licence Holder

·  Mr Michael Kirkbright - Partner

The hours applied for were as follows:

Retail by Sale of Alcohol

Monday to Sunday – 12:00 until 00:00 hours

Performance of Live Music and Recorded Music

Monday to Sunday – 12:00 until 23:00 hours

The application had received representations from West Yorkshire Police and the Environmental Protection Team, due to the prevention of crime and disorder and public nuisance. Both responsible authorities have since agreed measures, and those form part of the operating schedule.

In addition, the application has received an outstanding representation from one member of the public in regard to noise nuisance and public safety issues. The objector wished to remain anonymous and did not attend the hearing. All parties had received a redacted copy of the representation.

Mr Whipp and Mr Kirkbright addressed the Sub-Committee. This included addressing the issues raised in the representation and included the following submissions:

·  This was an old building which they had spent £70,000 bringing back into use. They had tried to recycle / re-use  as much of the materials removed during the building works as possible;

·  They had received a positive response on Facebook with 20,000 hits;

·  They want to bring people back into the high street and be part of the vibe of Garforth;

·  The bar is to cater for a more mature customers, not selling cheap beers but more premium brand beers, it is proposed that it would be a place where people can chill and relax;

·  The premises is not on a dangerous corner but is approximately 25 metres along from the corner. Members were advised that there is a parking space close to this particular corner;

·  There is a car park opposite the premises;

·  It is predominantly an area of commercial use, with little residential;

·  They themselves had not noticed any increase in anti-social behaviour (ASB) and had with them a letter from the Leeds Observatory, which also stated that there had not been an increase in ASB in Garforth;

·  Whilst carrying out the work to the premises they had used 8 yard skips and where possible had reused wood. There had been a bin used for the burning of scrap wood that could not be reused. On one occasion the Fire Service had been called out, and recorded the incident as a false alarm. The Fire Service had informed them that they could burn small fires, and after giving advance notice to the Fire Service, and they had burned old scrap wood 2 more times. However, they had been visited by the Environmental Officer who had told them to stop burning due to environmental issues, so they have not burnt anything further;
