Election of the Chair

To seek nominations for the election for the position of Chair.

Minutes:

RESOLVED – To elect Cllr J Gibson as the Chair for the duration of the meeting.

 

2.

Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

 

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance and Scrutiny Support at least 24 hours before the meeting)

There were no appeals against refusal of inspection of documents.

 

3.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

There were no formal late items, however, supplementary information was circulated to Members prior to the start of the meeting, which related to Item 6 - Application for the Grant of a Premises Licence for Otley Road Convenience Store, 80 Otley Road, Headingley, Leeds, LS6 4BA.

The report of the Chief Officer Elections and Regulatory requested Members consideration of an application for the grant of a premises licence made by Khabat Ahmad, for Otley Road Convenience Store, 80 Otley Road, Headingley, Leeds, LS6 4BA.

 

Present at the meeting were:

  • Tony Clarke (JMC Licensing Consultants) – Applicant's Representative
  • Michael Hurwood – Local Resident – Objector
  • Pam Wilson – Local Resident – On behalf of Far Headingley Village Society – Objector
  • Natalie Wells-Russell, Senior Caseworker for Alex Sobel MP – On behalf of Alex Sobel MP and Weetwood Ward Councillors

 

The Legal Officer set out the procedure for the hearing. It was agreed that the time limit for presentations to the Sub-Committee was to be extended to 20 minutes per party.

 

The Licensing Officer presented the application, providing the following details:

  • The original application had been amended since the distribution of the agenda, and supplementary information pack 1 detailed the amended hours for the sale of alcohol and the final conditions offered by the applicant and agreed with the responsible authorities.
  • The applicant and proposed DPS was not in attendance as they were out of the country due to a family member being unwell.
  • All objections from responsible authorities, detailed at appendix D of the report had been withdrawn, following additional proposed conditions to not to sell alcohol after 13.00 on Friday, Saturday and Sundays, and to not sell alcohol to any person in fancy dress costume. The conditions had been proposed in order the address concerns in relation to the Cumulative Impact Assessment (CIA) and the issues associated with the Otley Run.
  • Objections from other persons remained outstanding for consideration by the Sub-Committee, including objections from Alex Sobel MP, Ward Councillors, local residents and resident associations. Following notice of the amended operating schedule, one public objection had been withdrawn.
  • There had been one representation received by Entertainment Licensing in support of the application, contained at appendix G of the report.
  • The CIA 2023-2025 was contained at appendix H of the report, a map showing the location of licensed premises within the Cumulative Impact Area at appendix I and a list of licensed premises in the vicinity was contained at appendix J.

 

The applicant’s representative addressed the Sub-Committee providing the following information:

  • Apologies were given on behalf of the applicant for his non-attendance at the Sub-Committee, due to being out the country. The applicant had noted their sympathies towards the local residents and had leased the premises due to low rent costs and did not intend to exploit the Otley Run for profit.
  • The revision of the CIA to include Far Headingley was contested and considered ambiguous. The CIA policy was to be used in areas of high concentration of premises, and decision makers were to use robust and up to date information to include an area within the CIA.
