Election of the Chair

Minutes:

RESOLVED – To elect Councillor Wilkinson as Chair for the duration of the meeting.

Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

 

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance Services at least 24 hours before the meeting)

 

Minutes:

There were no appeals against refusal of inspection of documents.

3.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

A formal late item was submitted as Agenda Item 7 – Certification of Film (minute 7 refers) All Members had received the item prior to the start of the meeting.

To disclose or draw attention to any disclosable pecuniary interests for the purposes of Section 31 of the Localism Act 2011 and paragraphs 13-16 of the Members’ Code of Conduct.

The submitted report of the Head of Elections, Licensing and Registration set out an application to vary the premises licence held by Turtle Bay Restaurants Limited for Turtle Bay, Unit A14, The Light, Albion Street, Leeds, LS1 8TL.

 

In attendance at the hearing were:

Ms Ingram informed the Members that her clients Turtle Bay requested Members give consideration for an adjournment. She explained that her client was unable to attend due to a prior business engagement, and Anthony Lyons who usually represented Turtle Bay was also currently unavailable.

 

West Yorkshire Police had no objection to an adjournment.

 

Licensing Authority had no objection to an adjournment.

 

A date was agreed by all parties.

 

RESOLVED – To adjourn the hearing until Tuesday 24th April 2018 at 10:00am.

 

 

 

 

 

 

7.

Certification of Film

Minutes:

 The submitted report of the Head of Elections, Licensing and Registration advised Members of an application for the certification of a film to be shown at the Leeds Vue Cinema, 22 The Light, The Headrow, Leeds 1 on Tuesday 27th March 2018. This was a formal late item which had been received by Members prior to the start of the hearing.

 

The application had been received from the Film Label Ltd to have a film certified as it was not currently certified by the BBFC.

 

Members noted that the Vue Cinema, 22 The Light, The Headrow, Leeds 1 was currently licensed under the Licensing Act 2003 for Films.

 

Details of the BBFC guidelines were attached at Appendix A of the submitted report for Members consideration.

 

A brief synopsis and a recommended category in line with the BBFC classifications was attached at Appendix B of the submitted report for Members information.

 

Mr Coz Greenop attended the hearing.

 

Mr Greenop informed the Members that the film was due to premiere at Leicester Square on Thursday 22nd March 2018.

 

The Sub-Committee heard that Mr Greenop was a local person born in Leeds. He explained that the cast and crew were also from Leeds and Yorkshire and wished to screen the film at a Yorkshire cinema so family and friends could attend the showing.

 

In response to Members questions Mr Greenop explained that the film was to be shown world-wide with the first showing in Los Angeles in the next few weeks.

 

Mr Greenop was of the opinion that the film should receive a certification of 15 as there were no specific scenes of violence, or gratuitous sex.

 

Cllr. Wilkinson informed the Sub-Committee that he had watched the film and was also of the view that the film should be certified as a 15 or a PG.

 

Members considered the information presented to them.

 

RESOLVED – To certify the film Dark Beacon as a 15.
