To seek nominations for the election for the position of Chair.

RESOLVED – That Councillor P Wray be elected as Chair for the hearings.

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance and Scrutiny Support at least 24 hours before the meeting)

There were no appeals.

1)  To highlight reports or appendices which:

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

c)  If so, to formally pass the following resolution:-

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

There was no exclusions, however, a non-redacted version of the supplementary information submitted was distributed to Members ahead of the meeting.

There were no formal late items, however, some supplementary information was distributed to Members ahead of the meeting in relation to Item 6 – Summary review of the Premises Licence for Paradise Bar, Sheepscar Street South, Sheepscar, Leeds, LS7 1AD.

To disclose or draw attention to any disclosable pecuniary interests for the purposes of Section 31 of the Localism Act 2011 and paragraphs 13-16 of the Members’ Code of Conduct.

There were no declarations of disclosable pecuniary interests.

To consider the report of the Chief Officer (Elections and Regulatory) including an applciation for a summary review, made by West Yorkshire Police for Paradise Bar, Sheepscar Street South, Sheepscar, Leeds, LS7 1AD.

The Chief Officer (Elections and Regulatory) submitted a report informing Members of an application for a summary review in respect of Paradise Bar, 3 Sheepscar Street South, Sheepscar, Leeds, LS7 1AD.

An interim steps hearing took place on the 1^st August 2019, where the Licensing Sub Committee resolved to suspend the premises licence, pending the review hearing. Members were advised at the outset of the hearing that, on the 10th August, written notification was received from the designated premises supervisor (DPS) Mr Kelvin Garvey withdrawing his authorisation for alcohol sales with immediate effect. Therefore, there was currently no DPS in position.

The following were in attendance:

-  PC Cath Arkle, West Yorkshire Police

-  Martin Mynard, West Yorkshire Police

-  Dave Parker, West Yorkshire Police

-  Bob Patterson, West Yorkshire Police

-  Carmel Brennand, Entertainment Licensing, Leeds City Council

Mr Bassue, the Premises Licence Holder, was not in attendance.

PC Arkle advised the Sub-Committee that she intended to call Carmel Brennand as a witness. The Sub-Committee accepted the submission.

PC Arkle addressed the Sub-Committee, providing Members with an overview of the circumstances that led to the submission of the application. Members were informed that two males, one of whom was 17 years old, received knife and suspected glass related injuries in the early hours of Sunday 28th July 2019. The case was being treated as attempted murder.

PC Arkle noted that CCTV footage of the incident had been submitted to Members to view prior to the hearing. The Sub-Committee confirmed that they had viewed the footage.

PC Arkle advised Members of a number of breaches of the licence conditions on the night of the incident. Members were advised that the premises was open beyond the hours as set out within the licence. Members were also informed that persons under the age of 18 were permitted onto the premises, which Mr Bassue had previously stated was due to the premises holding a private party, however PC Arkle informed Members that none of the witnesses interviewed had described the event as a private party. PC Arkle also advised Members that glass bottles from the premises were suspected to have been used in the incident, despite the licence conditions stating that glass bottles should not be served at the premises.

PC Arkle informed Members that the witness present, Carmel Brennand, had seen the premises operating following the suspension of the licence. Ms Brennand informed Members that she drove to the premises at 3:18 am following a complaint received from a member of the public. Members learned that lights were on and music was playing, and that Ms Brennand saw 4 males enter the premises before she drove away at 3:24 am. Ms Brennand did not see any glass bottles or other drinks outside.
