To seek nominations for the election for the position of Chair.

RESOLVED – That Councillor Paul Drinkwater be elcted Chair for the hearings.

To disclose or draw attention to any disclosable pecuniary interests for the purposes of Section 31 of the Localism Act 2011 and paragraphs 13-16 of the Members’ Code of Conduct.

There were no declarations.

To consider the report of the Chief Officer (Elections and Regulatory) that advises of an application for the certification of five films in respect of the

Leeds Palestinian Film Festival. All screenings are scheduled to take place between 22^nd November 2019 and 6^th December 2019, at St. Anne’s Cathedral, Seven Artspace, Leeds University Union, the Rose Bowl and Woodhouse Community Centre.

The report of the Chief Officer (Elections and Regulatory) presented an application for the certification of films to be shown at the Leeds Palestinian Film Festival.

Frances Burnstein was in attendance to answer Members questions in relation to the screening of the films.

Prior to the hearing, all parties present agreed to the application being considered by only two members of the Sub-Committee.

The application sought classification for the following two films:

·  Wall – Recommended classification 15

·  Beyond the Frontlines – Recommended classification 15

In response to Members questions, it was reported that Wall was an animated film and had no violence, scenes of a sexual nature or foul language.  Beyond the Frontlines followed the story of a psychotherapist practicing in Occupied Palestine and did not have scenes of violence or a sexual nature.

The sub-committee adjourned to consider the applications and information presented.

RESOLVED – That the application be granted as requested.  Wall and Beyond the Frontlines to be given 15 classifications for the forthcoming Palestinian Film Festival.

To consider the Chief Officer (Elections and Regulatory) that advises of an application for the grant of a premises licence for Nawaz Restaurant 51 - 53 Austhorpe Road, Cross Gates, Leeds, LS15 8BA.

The report of the Chief Officer (Elections and Regulatory) presented an application for the grant of a Premises Licence for Nawaz Restaurant, 51-53 Austhorpe Road, Cross Gates, Leeds.

Mr E Judge, Cross Gates Watch Resident’s Association was in attendance.

Prior to the hearing, all parties present agreed to the application being considered by only two members of the Sub-Committee.

The application was for the sale by retail of alcohol every day from 12:00 to 00:00.  The alcohol sales are for consumption on and off the premises.

The application had received representation from West Yorkshire Police and others.  The representation from West Yorkshire Police had been withdrawn and the proposal for sales for consumption off the premises had been withdrawn.

A local resident addressed the sub-committee with concerns and objections to the application.  Although there was no objection to the premises having a licence to sell alcohol, there was concern that the application was for later than the permitted hours under planning permission and later than other premises that operated in the area.  Reference was made to other premises and decisions of the sub-committee in relation to these.  Further concern was raised regarding the application being from 12:00 as the access area was very busy during day time hours.  It was felt that 17:30 would be more appropriate.

The sub-committee adjourned to consider the application, report of the Chief Officer (Elections and Regulator) along with the representations submitted in writing and this made at the hearing along with the Council’s Statement of Licensing Policy.

RESOLVED – That the application for the sale of alcohol on premises be granted as follows:

Sunday to Thursday:  12:00 to 00:00

Friday and Saturday:  12:00 to 23:00

To consider the report of the Chief Officer (Elections and Regulatory) that advises of an application for the grant of a premises licence, made by Tingley Athletic FC Ltd, for Tingley Athletic FC Ltd, The Crescent, Casson Avenue, East Ardsley, Wakefield, WF3 2EG.

The report of the Chief Officer (Elections and Regulatory) presented an application for the grant of a premises licence for Tingley Athletic FC at The Crescent, Casson Avenue, East Ardsley, Wakefield.

The application was for the sale of alcohol Friday to Monday from 12:00 to 20:00.  The application had received representations from West Yorkshire Police and other persons.  The West Yorkshire Police Representation had been withdrawn following the agreement of conditions to the proposed lcence.

RESOLVED – That the hearing be adjourned as the applicant was not in attendance and the sub-committee sought clarification on issues relating to the application.
