• Authorisation to proceed with acceptance of the tender submitted by Leeds D&B One in the sum of £5,496,346.57 for the phase one works. Leeds D&B One will then enter into contract with Interserve Construction Ltd for £2,587,332.57 and Portakabin Ltd for £2,419,400. The contract sum of £5,496,346.57 also includes LEP fees of £489,614.
• In line with Leeds City Council’s Contract Procedure Rule 3.1.5, the requirements are subject to existing exclusive contract arrangements with Leeds D&B One.
• Note that the officer responsible for implementation is the Head of Service, Learning Systems and the Head of Programmes and Projects, City Development and authorise them as a signatory of all other contract related documentation that is required to deliver this project.

The Director of Children and Families Services gave permission to procure a new Step up to Social Work service via competitive tender. The duration of the contract will be 27 months; commencing from 1st Jan 2021 – 31st March 2023 and will offer a maximum of 35 funded student places. The maximum contract value will be £408,345 over 27 months.

The Deputy Director, Children & Families agreed the recommendation of a report relating to the placement of a child/young person. The individual costs of the place are £289,392.86.

The Chief Officer (Highways and Transportation):
i) noted the contents of this report; and
ii) gave approval to negotiate the terms of, and enter into an agreement with, Highways England to take over operation and maintenance of the existing traffic signals asset at M621 J7 upon completion of the LPTIP P&R scheme at Stourton, under the provision of Section 8 of the Highways Act 1980.

The Director of Adults and Health approved the modification of contracts during their term under Regulation 72 (1b) (i) & (ii) of the Public Contracts Regulations 2015 to vary the existing contract with Women’s Counselling and Therapy Service (WCTS) for the provision of therapy and counselling support to women.

This will commence 1st October 2020 and end on 30th June 2021 at a maximum cost of £107,505 for the period of nine months.

The Chief Planning Officer has approved the City Council’s formal response to the Pre-Submission Draft Headingley Neighbourhood Plan.

The Chief Officer (Highways and Transportation) waived Contract Procedure Rule 8.1 and 8.2 – Intermediate Value Procurements – and approved entering into contract with Department for Transport (DfT) for the new Street Manager digital service at an annual cost of £30,000 for the 20/21 and 21/22 financial years without seeking competition.

The Chief Planning Officer has approved the Re-Designation of the Garforth Neighbourhood Planning Forum for the Garforth Neighbourhood Area.

The Chief Digital and Information Officer approved the award of a contract to Microsoft for their Premier Support on an annual renewal basis for a period of 1 year from October 1st 2020 to September 30th 2021 using the Negotiated Procedure without prior publication.

Following the completion of a previous procurement exercise the Chief Officer Customer Access and Welfare approves the award of the contract, and spend of £35,575.00 to provide the supply and installation of hygiene side dividers and middle screens, to offer staff and customer safety as additional self-service PCs are opened up, to Opening the Book Ltd.

The Leader of Council has approved an amendment to the Constitution to reflect a change in her executive arrangements as detailed in the report attached.

The Chief Officer ( Highways and Transportation):
i) noted the contents of the report; and
ii) approved the application for a temporary pavement licences from premises listed in the Appendix 2, to operate a street café on the highway, as shown on the attached unnumbered drawings, which will expire when current restrictions, which are due to Government guidelines for COVID -19 are lifted.

The Chief Officer Partnerships & Health approved the decision to enter into four or five individual contract awards, following a competitive tender to re-procure Venue Hire Provision for the Workforce Development team.

The Director of Resources and Housing:
1. Authorised the required expenditure to enable the programme to progress the property acquisitions detailed in Confidential Appendix A. These acquisitions to be funded from the Council Housing Growth Programme budget, via a combination of Housing Revenue Account (HRA) borrowing and Right to Buy receipts.
2. Noted that Executive Board granted Authority to Spend for the programme on 24th July 2019.
3. Noted that a report is being submitted in parallel to the Director of City Development to request approval to acquire the properties for Housing & Resources so that they can be returned to Council Housing Stock.

The Chief Officer Asset Management and Regeneration has approved the sale of the subject site to the selected Preferred Bidder, the details and terms of which are contained within the confidential appendix.

To revoke the Direction prohibiting the event named the KMB Carnival Block Party proposed to be held on Saturday 29th August 2020 in LS9, relating to which the existing Direction had been issued to help prevent the spread of COVID-19 and protect the public’s health.

The Health Protection (Coronavirus, Restrictions) (England) (No. 3) Regulations 2020 came into force on 18th July 2020 (referred to as the Regulations).

The Regulations give the power to ‘the local authority’ to issue a Direction Notification. The designated officers are:-

Director of Public Health, Leeds City Council (and sub-delegated to the Deputy Director of Public Health, Leeds City Council in any absence)
Whose delegated powers include those to prevent the spread of a highly infectious disease being COVID-19 in order to protect the Leeds population by using powers under:-

• Officer Delegation Scheme (Executive Functions), 2) Health Protection Functions, c) providing the lead in public health incidents, and d) Communicable and infectious disease control; and
• Director’s Sub-Delegation Scheme, Specific Delegations 2d; and 9c of the Miscellaneous Functions from the Director of Adults and Health sub-delegation scheme – responding to emergencies that present a risk to public health.

A Direction Notification was issued on 28th August 2020 and was given due to the proposed event of a KMB Carnival Block Party being held on Kimberley Road, Leeds, LS9, such that this be prohibited in order to protect the Leeds population and the populations of surrounding Local Authorities from the significant Public health risk of COVID-19 and the spread of this highly infectious disease.

A decision has now been reached to revoke the existing Direction.

A brief statement of the reasons for the decision-

In accordance with the regulations the reason for this decision is that the occasion having passed on which the music event was scheduled to take place, it is the case that the conditions under Regulation 2 of the Health Protection (Coronavirus, Restrictions) (England) (No. 3) Regulations 2020 are no longer met.

The Head of Land and Property has approved the repurchase of a property on the terms detailed in the confidential appendix for Resources and Housing to return to council housing stock.

The Chief Officer (Highways and Transportation):
a) noted the detail of the highway works as outlined in section 3 of this report and shown on plan 18024-C4C-BB-ZZ-DR-A-0501 Rev Y attached at Appendix 3 of this report;

b) gave authority to negotiate the terms of, and enter into an agreement with, the developer under the provisions of Section 278 of the Highways Act 1980; whereby the works associated with the development are carried out by the developer and overseen by the Council;

c) gave authority to request the City Solicitor to advertise a new Traffic Regulation Order to provide No Waiting At Any Time parking restrictions within the newly constructed access (as shown on plan 18024-C4C-BB-ZZ-DR-A-0501 Rev Y attached at Appendix 3) and if no valid objections are received, to make, seal and implement the Order as advertised; and

d) gave authority to incur expenditure of £10,000 TRO costs and £6,000 staff checking and inspection fees to be fully funded by a developer through a Section 278 Agreement.

The Chief Officer (Highways and Transportation) approved the increase in fees and charges as set out in Appendix A to this report.

The Chief Officer Highways and Transportation approved costs of up to £88,425, with a capital injection of £88,425 from the S106 contributions from planning approvals 18/05738/FU and 18/01819/FU.

The Chief Officer (Highways and Transportation):
i) noted the detail of the highway works shown in outline in section 3 of this report and shown on plan VD19041-S278-100 Rev G attached at Appendix 3 of this report;

ii) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the Highways Act 1980; whereby the works associated with the development are carried out by the developer and overseen by the Council;

iii) gave authority to request the City Solicitor to advertise a draft Traffic Regulation Order to alter the extents of an existing taxi rank and protect a new informal crossing point with No Waiting At Any Time restrictions as shown on drawing VD19041-S278-100 Rev G shown at Appendix 3; and if no valid objections are received, to make, seal and implement the Order as advertised; and

iv) gave authority to incur expenditure of £10,000 TRO costs and £5,000 staff checking and inspection costs, all to be fully rechargeable to the developer through the Section 278 agreement.
