e) Approved with reference to the powers contained in section 66(4) of the Highways Act 1980, that the relevant lengths of footway shown on attached Drawing No 861-LCC-18-DR-TM-01_01 as proposed cycle tracks are removed and that following the removal of the existing footways, cycle tracks are constructed under the powers contained under the provisions of section 65(1) of the Highways Act 1980 for segregated or shared joint use by pedal cyclists and pedestrians.

The Chief Executive has granted dispensations, to those Leeds City listed at Schedule 1, for a period of four years in the following terms:-

A dispensation from both the restrictions in section 31(4) to take part and vote in relation to the consideration of a matter in relation to which they have a disclosable pecuniary interest arising through:-

• Any office held within Leeds City Council for which they receive a taxable income; and

• Any office held outside Leeds City Council (to which they have been appointed by Leeds City Council) for which they receive a taxable income.

A dispensation from the restrictions in section 31(4)(a) only to take part in the discussion of a matter in which they have a disclosable pecuniary interest to allow them to make representations at a meeting where members of the public have the same entitlement.

Section 33 of the Act provides that the authority (in the case of Leeds this function is delegated by Full Council to the Chief Executive) may, on written request, grant a dispensation relieving the Member from either or both of the restrictions imposed by Section 31.

The dispensation, which must be granted for a specific period not exceeding four years, may be granted on any of the following grounds:-

1. Without the dispensation the number of persons prohibited from participating in any particular business would so great as to impede the transaction of the business;

2. Without the dispensation the representation of different political groups would be so upset as to alter the likely outcome of any vote;
3. The dispensation is in the interests of persons living in the authority’s area;

4. Without the dispensation each Member of the executive would be prohibited from participating in business to be transacted by the executive; or

5. It is otherwise appropriate to grant a dispensation.

Authorise acceptance of the tender submitted by the Leeds Local Education Partnership, via Walter West Builders Ltd, in the sum of £1,862,579.96 noting that this is inclusive of all contract design and development fees, including the previously approved sum of £50,000 necessary to undertake the ‘Early Works’ programme.

c. Sanction the requirement to enter into a contractual agreement with Leeds D&B One Ltd. to deliver the works. This will take the form of a JCT contract between the Council and Leeds D&B One Ltd. for the sum of £1,862,579.96.

d. Note the programme dates identified in this report require the works to commence on Monday 4 April 2022.

The value of the contact will be up to £50,000 per annum and it will have a maximum length of 3 years (two years plus one) this means the maximum value over the contract period, should all extensions be utilised, will be up to £150,000.

The contract will be a call-off, based on medical need and expenditure varies each year but currently stands at approximately £40K per annum. Expenditure has previously been a little higher and is expected to rise again as children return to school following the pandemic.

All costs are being funded by WYCA’s TCF programme subject to completion of a variation to the existing Funding Agreement between WYCA and LCC and approval is sought to vary the agreement to this effect. £3,241,107 was requested as part of the change request form for the advance works. Surplus monies remain from the previous funding request for the utility’s diversion works and will be allocated to the advance works;

d) Gave authority to enter into a Basic Asset Protection Agreement with Network Rail for the works to Neville Street and Dark Neville Street. Note that the design for the highway’s works have been previously approved at the Highways Board on the 16th September 2021;

09/05/2022 - The Enhance Programme 2022/23 ref: 55205    

Brief Description

The Enhance Programme’s main aims are “to support safe and sustainable discharge from hospital and neighbourhood teams into a secure home environment and to link Neighbourhood Teams with third sector organisations to enhance capacity in both sectors and avoid both delayed discharges and readmissions.”

 

The total £800,000 funding budget is being provided by Leeds NHS Community Healthcare Trust (LCHT)  and there is no call on LCC funding for the programme. Leeds Older People’s Forum (LOPF) would administer the fund within the Leeds third sector through a bidding process.  The whole fund is intended to be distributed in 2022/23.

 

Adults and Health are taking the lead system role for this in partnership with LCHT as A&H  is the lead commissioner for Forum Central/LOPF and therefore has the existing infrastructure to manage the arrangement.

 

The decisions required are:

-  That LCC enters into an NHS Act Section 256 agreement with LCHT in order to receive £800,000 from LCHT and so that LCC can adopt the lead commissioning role for the Enhance Programme on behalf of the partnership between LCHT and LCC.

 

-  That £800,000 is grant-awarded to Leeds Older People’s Forum (LOPF)  in line with financial regulations so that they can distribute this to the Leeds third sector through a bidding process.

 

Impact On Wards

The Enhance Programme aims to improve outcomes for people living in all wards of the city (it is a city-wide scheme)

Financial and procurement implications

The £800,000 funding for the Enhance Programme is being provided by LCHT and the programme requires no call on LCC funding. It is proposed that the £800,000 LCHT funding is transferred to LCC using NHS Act flexibilities (a Section 256 agreement).

 

The proposal is that a direct grant award is made to LOPF. Note that the £800,000 is all for distribution within the Leeds Third Sector through a competitive bidding process and does not fund any LOPF administration costs (which are being met separately by LCHT).

LCC will also be making a contribution of £98k to the Enhance programme.  This is coming from funding received through the Health Partnerships Team from the Department for Levelling Up, Housing and Communities and Local Government to support people who are clinically vulnerable to Covid in March 2021 as discussed at the Winter at Risk Group chaired by Head of Regional Health Partnerships and programme lead for CEV.

b)  Authorise expenditure of £4,500,000 of the available Schools Condition Allocation grant on these essential condition works.

c)  Approve the proposed procurement strategy, using the in-house Procurement Team, and the use of the internal provider for some work areas and the Constructionline framework for the remaining programme.

09/05/2022 - Managing Social Work (SW) and Occupational Therapy (OT) Capacity and Demand - To support ASC transformation aligned to budget action plans and stabilisation of the service ref: 55206    For Determination

Brief Description

This report is requesting two decisions to be approved by the Director of Adults and Health as follows:

 

Decision 1

  • Approval of the expansion of the current staffing structures to support the transformation as set out in the exec board report, which would support an increase in staffing numbers for both Social Work and Occupational Therapy roles. In addition to this, appropriate plans will need to be in place to ensure the management structures are appropriate in line with this plan which will also include an expansion of the team manager numbers.

 

  • The exact numbers are not yet confirmed so the report is seeking a decision that is flexible and enables this resource modelling to be undertaken alongside HR and finance colleagues so the post ID’s can be created as posts are recruited to.

 

Decision 2

  • Variation to the contract(attached) to enable the continued funding of the Peri Team.  The current funding ends on 29/04/22 and is not re current. This report is seeking ongoing funding for a further six months.

·  For six months total cost (at full capacity) = £319,042.

 

Service transformation 2022/23

An Exec Board report was approved in December 2021 to support Adult Social Care (ASC) service transformation in the following areas:

 

1)The proposal to invest £660,253to deliver a pilot that uses Occupational Therapy and additional Social Worker staff at “the front door” to maximise capacity to meet growing demand for information and advice and demand for a social care assessment of needs, embedding an “independence first” approach.

 

2)The proposal to invest £646,323 to deliver a pilot of a new Community Reviewing Team that includes Occupational Therapy and Social Work staff to enhance the capacity of the current Adult Reviewing Team in order to deliver an increased reviewing schedule. Note that this investment is anticipated to deliver £3.3m from 2022 – 2025.

09/05/2022 - Care and Support procurement for the Kirklands Autism Service ref: 55208    Recommendations Approved

Brief Description

To secure a highly specialist care and support provider to deliver the support within a bespoke specialist 6 bed residential accommodation for adults with severe learning disabilities and complex autism will be built on the site of the former Kirkland House care home in North-West Leeds.

The service to be procured will provide services to Leeds residents from all areas. The site for development is within the Guiseley and Rawdon Ward.

Financial and procurement implications

The support aspect of the scheme is expected to indicatively cost £1.5 million per annum to be funded jointly between LCC A&H and the CCG.

Leeds CC is taking the lead role, working in partnership with Leeds Clinical Commissioning Group (CCG) and NHS England.

Decision:

The Deputy Director of Adults and Health approved the request to commence the process to procure a specialist care and support provider for the Kirklands Autism Service in Leeds.  The contract will be awarded for an initial period of 6 years (with an option to extend for a maximum period of 48 months in any combination). The value of the initial contract period is set at an anticipated total maximum cost of £9 million (£1.5 million per annum).  Should any extension period be utilised then will be subject to a separate decision at the appropriate time.  The anticipated total maximum cost of the service, should all of the available extension provisions be utilised, will be £15 million (£1.5 million per annum). The formal decision to let the contract to a preferred provider will be taken at a later date following a decision by Executive Board to approve capital expenditure on the programme. Please see para. 22.

 

To note that officers on behalf of Adults and Health Integrated Commissioning and Procurement and Commercial Services (PACS) will complete all the necessary actions to ensure that this contract is in place by November 2022, including a suitable lead-in time.
