Decisions

The Chief Officer – Financial Services approved the revised CPRs and approved that they will come into effect on 1st July 2018.

That the Director of Resources and Housing approved the award of the contract for Pudsey Town Hall Window replacement (manufactured joinery) and associated works contract to Walter West Builders Ltd for the sum of £145,249.49.

The Chief Officer (Highways and Transportation):
i) noted the highway works as outlined in Section 2.3 and as shown on drawings 70038464-WSP-HGN-J27-DR-CH-01_06 and 70038464-WSP-HGN-J28-DR-CH-01_01 attached;
ii) approved an injection of £5,735,000 into the City Development Capital Programme to be fully funded by Highways England;
iii) gave authority to incur expenditure of £4,725,000 works costs and £1,010,000 staff costs to be fully funded by Highways England;
iv) gave authority to complete the detailed design, tender the works through the Highways Term Contract – Option A and implement the works as set out in Section 2.5; and
v) approved the undertaking of the implementation of schemes at Junction 27 and 28 of the M62 to improve capacity and reduce congestion.

The Director of City Development;
i) approved the contents of this report and;
ii) requested the City Solicitor to advertise a Traffic Regulation Order as detailed on enclosed drawing TMW/17/3132 to introduce a new loading bay outside Headingley Community Hub, and to relocate the current disabled bay and subject to no objections being received to make and seal the order as advertised.

The Director of City Development;
i) noted the contents of this report;
ii) gave authority to procure consultant services to develop the pipeline scheme proposals;
iii) sought authority to submit a planning application for multi-storey car park on Netherfield Road in Guiseley;
iv) approved the injection of £143k into the Capital Programme to be spent as fees this financial year; and
v) incurred fee expenditure of £143k, all to be fully recharged to WYCA.

The Chief Officer (Highways and Transportation):
i) instructed the City Solicitor to apply to the magistrates’ court for a stopping up order under the provisions of Section 116 of the Highways Act 1980 for the area of adopted highway shown hatched on Drawing SD/217960/GS/01B.

The Chief Officer (Highways and Transportation):
i) approved the extension of the Underwater Inspections Contract for a further 12 months to 30 June 2019 in accordance with its terms and conditions.

Approve the waiver of CPR 8.1 and CPR 8.2 to enter into a new contract with Bircham Dyson Bell without seeking further competition, for a period of 16 months

The Director of City Development;
i) noted the contents of this report; and

ii) approved the proposal at the total cost of £400,000; and

iii) gave authority to incur expenditure of £370,000 works costs and £30,000 staff costs, being part of the Transport Policy Capital Programme 2018/19 ( LTP Government grant funding).

The Chief Officer (Highways and Transportation):
i) noted the contents of this report; and
ii) approved the application from Oporto, for a licence to operate a street café on the highway at 31 to 33 Call Lane, Leeds, LS1 7BT, as shown on the attached drawing numbered (20)001OP, to expire on the 31 March 2019 and that future licences be renewed annually, subject to satisfactory operation, and with approval from The Chief Officer Highways and Transportation.

The Director of City Development;
i) gave approval to these proposals to enable the installation of minor access/ pedestrian measures; and
ii) gave authority to incur expenditure of £70,000 funded from the LTP Transport Policy Capital Programme.

The Director of City Development;
i) approved the extension of the Mobile Elevated Working Platforms Contract for a further 12 months to 30 June 2019 in accordance with its terms and conditions.

The Director of City Development;
i) gave approval to the proposals outlined in this report;

ii) gave approval to inject £31,274.13 into the capital programme, to be fully funded from a section 106 receipt; and
iii) gave authority to incur expenditure of £ £31,274.13 (comprising £6,000 staff fees and £ 25274,13 works costs ), to be fully funded from a section 106 receipt.

The Chief Officer (Highways and Transportation):

i) noted the highway works as detailed in Section 3 and shown in principle on GA drawing MUS-ARUP-ZZ-XX-DR-C-1308;

ii) gave authority to incur expenditure of £6,000 TRO costs, £1,000 90C notice costs and £5,000 staff checking and inspection costs, to be fully funded by the developer through the Section 106 and Section 278 agreements;

iii) requested the City Solicitor to
a. advertise a draft Traffic Regulation Order to facilitate the necessary waiting restrictions, as shown on Traffic Regulation Order GA drawing MUS-ARUP-ZZ-ZZ-DR-C-1309, and, if no valid objections are received, to make, seal and implement the order as advertised; and
b. advertise a draft Speed Limit Order to introduce a 20mph speed limit as shown on drawing MUS-ARUP-ZZ-ZZ-DR-C-1309, and, if no valid objections are received, to make, seal and implement the order as advertised; and
c. advertise a notice under Section 90C of the Highways Act 1980 to provide traffic calming as shown on GA drawing MUS-ARUP-ZZ-XX-DR-C-1308;
iv) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the Highways Act 1980.

The Director of Resources & Housing approved this request in accordance with CPR 3.1.8, to secure a supplier to manufacture and install new windows at Pudsey Town Hall. The estimated cost of replacing 3 out of 4 elevations in £245.000.00.

The 4th Elevation cannot be completed at this stage due to complicated road closure issues which are ongoing. It is recommended that this elevation is not progressed at this stage.

Approved the proposed procurement route, to identify suitable approved providers from Construction line (Government approved list managed by Capita) to invite tenders and ultimately to be appointed as main contractor to carry out the works.

The Director of Resources and Housing is agreed to approve the Write off irrecoverable Former Tenants Arrears in the sum of £98,588.11 represented by 80 accounts in relation to the citywide accounts.

The Deputy Director, Children & Families agreed the recommendation of a report relating to the placement of a child/young person. The individual costs of the place are £247,000.00.

Approval was granted for the creation of the 13 permanent project management and procurement positions identified in this report onto the Property & Contracts structure in order that Property & Contracts can deliver its £115 million p.a procurement strategy over the next 5 years to be funded from the Housing Revenue Account.

The Chief Digital and Information Officer agreed to approve the award of a framework for ICT Goods Supply, Maintenance, Disposal and Services on behalf of Leeds City Partners and to approve award of a call off contract under the framework to provide services to the Council for a period four years. The decision to award is a direct consequence of previous Key Decision D44928.
Appendix 1 to this report has been marked as exempt under Access to Information Procedure Rules 10.4 (3) on the basis that it contains information relating to the financial or business affairs of any particular person (including the authority holding that information) which, if disclosed to the public, would, or would be likely to prejudice the commercial interests of that person or of the Council. The information is exempt if and for so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information. In this case the report author considers that it is in the public interest to maintain the exemption.

The Deputy Chief Officer for Waste Management noted the contents of this report and approved the existing orders that have been placed for wheeled bins. Authorisation is also approved for further spend with the identified suppliers until a YPO call off is concluded.

The Chief Officer Comunities approved the recommendations to:
• Continue to fund third sector providers the Refugee Council and RETAS (Refugee Education Training and Advice Service) to provide regional and local support under the resettlement programme.
• Allow the third sector providers to extend the scope of their support to cover the Vulnerable Children’s Resettlement Scheme (VCRS) in addition to the Vulnerable Persons Resettlement Scheme (VPRS), and to extend the period of support for refugee to five years from date of arrival under both the VCRS and VPRS.
• Enter into a grant funding agreement with the Refugee Council for a value of £4.2m and RETAS for £476K each with a term of Dec 2017 to 30th Dec 2024.
• Such agreements to be a form approved by the Head of Migration Yorkshire.

Seek approval to award a contract for the Home Independence and Warmth Service to Care and Repair Leeds (lead contractor) from the 1st October 2018 until the 30th September 2021, with the option to extend the contract up to a maximum of two years, following the satisfactory conclusion of the vetting and procurement process.

To award a contract for the supply of fresh fruit and vegetables to GT Produce Ltd for a period of three years from 01 July 2018 (with an option to extend by 1 x 12 months)

The Chief Officer for Parks and Countryside is requested to use the authority set out in Contract Procedure Rule (CPR) 1.3 to waive Contracts Procedure Rule No 8.1 and 8.2 – Intermediate Value Procurement – to enter into a contract for the restoration of the Books of Remembrance direct from FG Marshalls Ltd.

The Director of Children & Families agreed the recommendation of a report relating to the placement of a child/young person. The individual costs of the place are £410,280.00.

The Director of Children & Families agreed to:

• Note the negotiations held with Solicitors acting on behalf of the Governing Body and The Trust; and

• Give authority for the Commercial Transfer Agreement to be executed and completed to enable the Academy to open on 1st July 2018.

The Chief Officer for Resources and Strategy has approved a waiver of the Contract Procedure Rules to permit the Visitor Economy and Inward Investment service to proceed with the purchase of the exhibition space at The Meetings Show 2018 from Centaur Media, PO number Z028444 for the value of £12,150 (plus VAT) as this is a sole supplier situation. They are therefore unable to obtain three written quotes and the value of an order is between £10,000 and £25,000.

This will allow the Visitor Economy and Inward Investment Service to successfully deliver the Executive Board approved strategic approach and forward plan in which the nature of the business and unique circumstances of the service being delivered results in the required procurement.

The Chief Officer (Highways and Transportation):
i) noted the principles of the highway works as outlined in Section 6.2 and shown indicatively on Drawing Number EP/732696/GA/01 as shown at Appendix 3 of this report; and
ii) advertised a draft Traffic Regulation Order to reduce the speed limit to 40mph (from 50mph) along the site frontage; and if no valid objections are received, to make and seal the TRO as advertised.
iii) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the Highways Act 1980; whereby the works associated with the development are carried out by this Council at the cost of the developer; and
iv) gave authority to incur expenditure of £70,000 works costs and £17,000 staff costs to be fully funded by a developer through a Section 278 Agreement; and
v) gave authority to carry out the detailed design, tender and implement the works as set out in Section 6.2.

The Director of Resources & Housing has approved the sub-delegation scheme attached as Appendix 1 to the attached report.

The Chief Officer Culture and Sport has approved the decision to revise the funding award schedule to Leeds Grand Theatre & Opera House Ltd.

This funding would be taken from the arts@leeds budget:
- April 2018 payment of £130k
- April 2019 payment of £130k
- April 2020 payment of £105k
- April 2021 payment of £55k

The Area Head of Targeted Services (ENE) agreed to publish the attached record of decisions made in May 2018.

The Head of Learning Systems agreed to:

i) Note the effects of the storm and flood damage and the ongoing essential repair works required at Royds School.

ii) Authorise expenditure in the sum of £249,000 from capital scheme number 32877/000/000.

The Deputy Director Children & Families approved the waiver of Contracts’ Procedure Rules 8.1 & 8.2 in order to enter into a 32 month contract with Home-Start Leeds for the post removal service.

The Chief Officer Highways and Transportation:
i) Approved the waiver of Contract Procedure Rule 8 – between £10K and £100K Intermediate Value Procurement (Quotations); and
ii) Approved entering into a contract with Drakewell Computer Systems for continuing support of the C2 data system for a period of 4 years at a cost of £35,360.

The Chief Officer Highways and Transportation has approved the continuation of the current agreement for the provision of ADSL and Ethernet circuits with Zen Internet Ltd for the control and monitoring of traffic signals for a period of up to 31st March 2020 to allow the proposed West Yorkshire UTMC time to decide on a strategy for communications.
