Purpose:

The decision to award this cooperation agreement falls within Clause 1.5.2 of the Contract Procedure Rules as it is a cooperation between two public bodies and falls outside of the Public Contract Regulations pursuant to Regulation 12(7). Therefore it is not a procurement for the purpose of the Contract Procedure Rules.  This is a key decision because the value of the contract is over £250k per annum.

Decision:

The Director of Children and Families agreed to award cooperation agreements to East SILC academy, or whatever name the academy is given on conversion, for the delivery of MNTS and the PD & Med Service as follows:

 

a.  MNTS: The agreement shall commence when East SILC converts to an academy and expire three years later, with a value of approximately £1,246,960 per annum. This decision falls within Clause 1.5.2 of the Contract Procedure Rules as it is a cooperation between two public bodies and falls outside of the Public Contract Regulations pursuant to Regulation 12(7). Therefore it is not a procurement exercise for the purpose of the Contract Procedure Rules.  This is a key decision because the value of the cooperation agreement is over £250k per annum.

 

b.  PD & Medical service: The agreement shall commence when East SILC converts to an academy and expire 12 months later. The value will be £94,185 for 2017/18 and the value for 2018/19 will be determined by the findings of a review of the service. This decision falls within Clause 1.5.2 of the Contract Procedure Rules as it is a cooperation between two public bodies and falls outside of the Public Contract Regulations pursuant to Regulation 12(7). Therefore it is not a procurement exercise for the purpose of the Contract Procedure Rules.  This is a significant operational decision because the value of the cooperation agreement is over £10k per annum.
