From April 2013 the Local Authority became responsible for the administration of element 3 funding. This is top up funding (element 1 and element 2) to enable a student with high needs to participate in education and learning. The Education Funding Agency (EFA) makes an allocation to Local authorities for element 3, through the Dedicated Schools Grant (DSG). This forms part of the high needs budget. Local Authorities then use their high needs budget to pay top-up funding to institutions. The Head of Complex Needs wishes to put robust contract arrangements in place with all providers in receipt of element 3 funding to ensure all learners achieve good outcomes.

3. Proposals for the re-commissioning of these services will be the subject of further reports. During the review and interim contract period, new ways of working will continue to be developed with providers and key partners – an example of this being the Conditional Cautioning pilot that will enable more effective engagement and signposting to DIP/IOM interventions for specific types of offences, including low level domestic violence.

Public Contracts Regulations
which are effective from 26 February 2015 for all new procurements

which have not commenced before 26 February) that either include a
prequalification
stage and / or are over the relevant EU procurement monetary
thresholds. The new Regulations prevail over current CPRs where
there is any
inconsistency. The Commercial team within the Unit are working to
update the
detail of CPRs to accommodate all the changes, but given the
extremely short
notice for implementation of the new Regulations these will need a
longer
period to finafise and enable consultation as appropriate. The
Chief Officer
Public Private Partnerships and Procurement has been asked to
approve the
contents of and publication of an addendum provided with this
notification which
summarises the key changes and the CPRs affected. Current CPRs will
be
amended to incude a note referring users to the Addendum.

Foundation:

Contract value not exceeding £429,739.65 per annum. This reflects a saving of 10% on the current contract value.
A six month contract for the Adult Offender Accommodation Based service commencing 1st April 2015 to 30th September 2015 with an option to extend for further separate six and twelve month periods. Contract value not exceeding £162,047.38 per annum.This reflects a saving of 10% on the current contract value.
Home Group:
A six month contract for the South Leeds Tenancy Sustainment service commencing 1st April 2015 to 30th September 2015 with an option to extend for further six and twelve month periods. Contract value not exceeding £80,081.40 per annum.This reflects a saving of 8% on the current contract value.
A six month contract for the Kirkstall Lodge service commencing 1st April 2015 to 30th September 2015 with an option to extend for further six and twelve month periods. Contract value not exceeding £52,678.50 per annum. This reflects a saving of 13% on the current contract value.

Approve the waiver of Contract Procurement Rules 9.1 and 9.2 to enable the Council to award new contracts to Leeds Community Healthcare NHS Trust and GPs, who are existing providers of key public health services. New contracts are required as there is insufficient contract extension provision available to maintain existing services during the review and competitive procurement of public health key priorities including healthy lifestyles, healthy child pathway, NHS Health checks and Infection Control.
The overall value of these contracts is approximately £5.3 million per annum, and the proposed new contracts would start on 1st April 2015 for 2 years with extension provision in order to ensure services are not disrupted and time is allowed for review and competitive procurement.

Awarding new contracts without seeking competition to these existing providers will ensure stability and continuity of key public health services whilst providing a sufficient period for the Public Health Direcotriate to work with Public Private Partnerships and Procurement Unit (PPP & PU) to undertake strategic reviews and competitive procurements of key public health priorities including Healthy Lifestyles (including smoking cessation), Healthy Child Pathway, NHS Health checks and Infection Control. The new contracts will also align with the contract end dates for the Health Visiting and Family Nurse Partnership services to enable a full service review of the Healthy Child Pathway (0 to 19 years) to be undertaken if required.
The total annual value of these contracts is £5,175,900.
