Decisions

The Director of Children’s Services agreed to:
• Note the negotiations held with Solicitors acting on behalf of the Academy, DfE, Academy Trust and PFI Consortium;
• Give authority for the following Agreements to be executed and completed to enable the Academy to transfer on the 1st September 2015:
o Deed of variation;
o LCC License to Assign
o Deed of Novation;
? Commercial Transfer Agreement;
? Principal Agreement; and
? Schools agreement.
• Together with any other documentation required to complete the transfer; and
• Give authority for any other necessary action to be taken to effect the transfer.

The Director of Children's Services approved the waiver of the following contract procedure rule(s):

Contract procedure rules No. 8.1 and 8.2 - Intermediate value procurements, and award a contract to Wellspring in the sum of £80,000. The contract shall commence on the 31st August 2015 and expire on 31st August 2016.

The Natural Environment Manager authorised the declaration of paths at the former Gamblethorpe Tip site as public rights of way which will result in the addition of six bridleways and a footpath to the Definitive Map and Statement.

Approved the award of an Asbestos survey contract for 3 years with an extension of one further year.

The Director of Adult Social Services approved the recommendation to incur expenditure of a total of £165,000 to fund the creation of a community base at Cross Gates Community Centre on scheme 14997CRO in line with the agreed programme of works. The proposed timescale for the implementation of the decision is from October to December 2015. The Project Manager, Adult Social Care Programme Management Office, is responsible for implementing the decision.

The Director of City Development has approved the terms for the acquisition of the properties to be developed at the subject site.

The Director of City Development has approved the terms for the Waiver of Contract following Contracts Procedure Rule: 9.1 (High Value Procurements) and allow the Council to enter into a purchase agreement for the land and 8 no units being constructed by the current landowner RDF Leeds Ltd on the former Lord Cardigan Pub site.

The Head of Engineering Services:

i) noted the highway works as outlined in Section 3.3 and indicated on drawings WB/RL/003 Rev B and S106 Highway Works Plan attached at Appendix 1;
ii) gave authority to implement the works as set out in Section 3.3; and
iii) gave authority to incur expenditure of £400,000, being £330,000 works costs and £70,000 staff costs, all to be fully funded by the developer from the signed S106 Agreement.

The Head of Engineering Services:

i) noted the contents of this report;

ii) noted the cost of the additional works as £678,000 which are to be fully funded by the Developer from a separately held account;

iii) authorised the injection of £678,000 into the Council’s capital programme, fully funded by the Developer;

iv) gave authority to incur expenditure of £678,000 in delivering these additional works, fully funded by the Developer.

The Assistant Chief Executive (Citizens and Communities) has approved the sub-delegation scheme as described in and set out as Appendix 1 to the attached report.

The Area Head of Targeted Services (ENE) agreed to publish the attached record of decisions made in July 2015

The City Solicitor has approved the sub-delegation scheme as described in and set out as Appendix 1 to the attached report.

The Head of Asset Management has accepted to list the former Shoulder of Mutton, 31 Potternewton Lane, Chapel Allerton. Leeds LS7 3LW on the List of Assets of Community Value on the basis that the nomination satisfactorily meets the criteria laid down in the Localism Act 2011.

The Director of Children's Services agreed to waive contrct procedure rule 9.1 and 9.2 and award the contract for clinical support and supervision to the therapeutic social work team to Leeds Community Healthcare Trust (LCHT) for 12 months with a possible further one year extension.

The Head of Engineering Services:

i) authorised the detailed design and implementation of a scheme to introduce ‘No Waiting At Any Time’ restrictions at the junction of King Edward Crescent and King Edward Avenue, at the junction of Broadgate Lane and King Edward Avenue and in Chaddlewood Close, Horsforth. Details are shown on drawing no: TM-18-2323-12-01A;

ii) approved the design and implementation of a speed hump and speed cushions on North Broadgate Lane/ Broadgate Lane and to raise the existing crossing points of two existing zebra crossing facility with extending the footway build-outs associated with them, at the location of North Broadgate Lane/ Broadgate Lane, Horsforth, at a cost of £42,000. Details are shown on drawing no: TM-18-2323-12-01A; and

iii) gave authority to display a Notice under the provision of Section 90c of the Highways Act 1980, to inform members of the public of traffic calming measures in the form of a speed hump, raising the existing zebra crossings points and the provision of speed cushions all on North Broadgate Lane/ Broadgate Lane, Horsforth.

Requested the City Solicitor to:
a) Advertise a draft Traffic Regulation Order to introduce ‘No Waiting At Any Time’ restrictions at the junction of King Edward Crescent and King Edward Avenue, at the junction of Broadgate Lane and King Edward Avenue and in Chaddlewood Close, as shown on drawing TM-18-2323-12-01A; and if no valid objections are received, to request that the City Solicitor make, seal and implement the orders as advertised; and

b) Advertise a notice under Section 90c of the Highways Act 1980 to provide traffic calming measures in the form of raising the existing two Zebra crossings points to humped crossings, the provision of speed cushions and a speed hump on North Broadgate Lane/ Broadgate Lane, Horsforth.

The Head of Engineering Services:

i) approved, subject to public consultation, the detailed design and implementation of a scheme to amend some of the existing traffic calming features on Town Street, Middleton, at an estimated cost of £18,562;
ii) gave authority to advertise a Notice for the road humps that conforms with the Highways Act 1980 (90c Notice);
iii) gave authority to incur expenditure of £18,562 to be funded from the Shape Lane Section 106 private development receipts.

The Chief Officer for Housing Management agrees to recruit 4 x two year duration, grade (C1) graduate Project Officers posts within the Housing Leeds, Housing Management Division.
Post creation to support delivery of projects associated with implementation of current and future Housing Leeds service objectives.

The Chief Officer Culture and Sport has agreed to waive Contracts Procedure Rule No 3.1.15 (Requirement to use the Council’s standard tender documents for the procurement of appoint the following companies to provide vending services) and 8.1 & 8.2 (Intermediate Value Procurements)in order to appoint the contract for the vending of Sports Nutrition Products to the Leeds based company ‘Nutrition2Go’.

The Chief Officer, Partnership Development and Business Support approved the decision to waive contract procedure rule 8.1 and 8.2 and purchase the two additional modules from Tribal Services to support the work atound promotion and take-up of places for eligible 2 year olds.

The Director, Environment and Housing approved the request to provide a voluntary grant of £10K per annum for a three year period covering 2015 to 2018 to Unipol Student Homes to be used to support initiatives in the private rented sector.

The Chief Officer of Housing Management agreed to approve the proposal for the partnership agreement with WYCAS to a value of £8,648.00. In line with the following Contract Procedure Rule Guidance 7.1

The Director of City Development has reviewed the decision to add The Old Cock, 11 Crossgate, Otley, LS21 1AA to the List of Assets of Community Value and agreed that the asset should remain on the list.

The Director of City Development has reviewed the decision to add Otley Tap House,66 Boroughgate, Otley, LS21 1AE to the List of Assets of Community Value and agreed that the asset should remain on the list.

The Director of Environment and Housing has approved the terms for the acquisition of the properties to be developed at the subject site.
