The Chief Officer (Highways &
i) noted the principles of the highway works as outlined in Section 3.2 and shown on drawing nos. 17/433/TR/004 Rev B and 17/433/TR/010 at Appendix 3A and 3B of this report;
ii) gave authority to advertise and introduce a Traffic Regulation Order for waiting restrictions on Leopold Street, Spencer Place and surrounding streets; and to advertise a notice under the provisions of Section 23 of the Road Traffic Regulation Act 1984 and 90c of the Highways Act 1980; and if no valid objections are received, to make, seal and implement the Order as advertised;
iii) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the highways Act 1980; whereby the works associated with the development are carried out by this Council at the cost of the developer;
iv) gave authority to incur expenditure of £116,000 Works costs, excluding statutory undertakers diversions and £26,500 Staff costs , to be fully funded by a developer through a Section 278 Agreement;
v) gave authority to carry out the detailed design, tender and implement the works as set out in Section 3.2; and
vi) noted the requirement under Section 106 of the Town and Country Planning Act 1990, as outlined in paragraph 2.9, for the developer to pay a sum of £20,000 for the purposes of highway monitoring and carrying out of additional mitigation measures should these be required within 10 years of first occupation of the development.
