To consider the report of the Director of Resources providing an update on the transfer of public health functions, resources, assets and liabilities to the Council under the statutory process set out in the Health and Social Care Act 2012.  In addition, the report seeks approval to delegate decision making to the Chief Executive in respect of the approval of the final agreed list of resources, assets and liabilities transferring to the Council under the Health and Social Care Act 2012.

The Director of Resources submitted a report providing an update on the transfer of public health functions, resources, assets and liabilities to the Council under the statutory process, as set out within the Health and Social Care Act 2012. In addition, the report sought approval to delegate decision making to the Chief Executive in respect of the approval of the final agreed list of resources, assets and liabilities  transferring to the Council under the Health and Social Care Act 2012.

RESOLVED –

(a)  That the contents of the submitted report, together with the functions, budget, resources and assets and liabilities due to transfer on 1^st April 2013 be noted.

(b)  That the relevant decision making authority be delegated to the Chief Executive, in order to enable him to approve:-

(i) the Transfer Scheme relating to staff; and

(ii) the Transfer Scheme relating to assets and liabilities.

(c)  That it be noted that the Council will award new contracts for existing services where they expire prior to 31^st March 2013, which will be approved under the Officer Delegation Scheme.
