RESOLVED – That Councillor P Wray be elected as Chair for the hearings.

Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

3.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

Application for the Renewal of a Sex Establishment Licence for Liberte,

The report of the Chief Officer (Elections and Regulatory) presented an application for the renewal of a Sex Establishment Licence for Liberte, 10 York Place, Leeds.

 

The Legal Officer outlined the procedure to be followed and the Licensing Officer presented the application.

 

The application was for renewal of the Sex Establishment Licence and there had not been any representations from the responsible authorities or the public.  Details of the current licence were outlined in the report.

 

Mr Luke Elford, representing the applicant and Bianca Haruta, the applicant, were in attendance.  The sub-committee was informed that there would be no changes to the existing style of operation and no changes to the external appearance of the venue or advertising material to be used.

 

In response to questions from the sub-committee it was confirmed that there would not be the deployment of vehicles to collect customers and there would not be any changes to the internal layout.

 

The Licensing Sub-Committee carefully considered the application, the report and representations made a the hearing.

 

RESOLVED -That the application for renewal be granted as applied for.

Application for the Renewal of a Sex Establishment Licence for Purple

The report of the Chief Officer (Elections and Regulatory) presented an application for the renewal of a Sex Establishment Licence for Purple Door, 5 York Place, Leeds.

 

The Legal Officer outlined the procedure to be followed and the Licensing Officer presented the application.

 

The application was for renewal of the Sex Establishment Licence and there had not been any representations from the responsible authorities or the public.  Details of the current licence were outlined in the report.

 

Naomi Shaw, representing the applicant, Nicholas Quadrini and Carl Copeland were in attendance.  The sub-committee was informed that the premises had been trading since 2005 and since 2011 under the present licensing regulations.  It was reported that there would be no changes to the existing style of operation and no changes to the external appearance of the venue or advertising material to be used.  There had not been any objections to the application and as the premises were in an appropriate area and not close to any sensitive properties it was requested that the application be granted as applied for.

 

In response to questions from the sub-committee it was confirmed that there would not be the deployment of vehicles to collect customers and there would not be any changes to the internal layout.

 

The Licensing Sub-Committee carefully considered the application, the report and representations made a the hearing.

 

RESOLVED -That the application for renewal be granted as applied for.

Application for the Grant of a Premises Licence for 27 Station Road, 27 Station Road, Horsforth, Leeds, LS18 5PA pdf icon PDF 147 KB

The report of the Chief Officer (Elections and Regulatory) presented an application for the grant of a Premises Licence for 27 Station Road, Horsforth, Leeds.

 

The Legal Officer outlined the procedure to be followed and the Licensing Officer presented the application.

 

The application was for the sale of alcohol for consumption off the premises every day from 07:00 to 23:00.

 

The application had received representations from West Yorkshire Police and local residents.  A number of conditions had since been agreed with West Yorkshire Police which included CCTV, keeping an Incident Report Register. Supervision of alcohol on the premises and advertising standards.

 

The following were in attendance:

 

-  Mr M Ainsworth – Representing the applicant

-  Mr K Ahmad – Applicant

 

-  Mr & Mrs Wilson – Local residents.

 

The applicant’s representative addressed the Sub-Committee.  The following was highlighted:

 

·  The applicant had a history of running similar premises without any incidents or complaints.

·  The applicant had already implemented the kind of conditions requested by the police in other premises.

·  The application would meet all of the licensing objectives.

 

In response to questions from the Sub-Committee, the following was discussed:

 

·  The applicant was prepared to operate the ‘Challenge 25’ scheme as part of the measures to prevent anyone under age from buying alcohol or tobacco.

·  With regard to concerns regarding noise nuisance and litter, it was reported the premises were on an attractive shopping parade and the applicant would not want to contribute to any disturbance.  Any litter would be cleared from outside the premises at closing time.

·  Single cans of alcohol would not be for sale.  This would discourage those who wanted to drink immediately or drink in the streets.

 

A local resident addressed the Sub-Committee with concerns and objections to the application.  These included the following:

 

·  There were already enough shops selling alcohol and tobacco in the area.

·  One of the local shops had started closing earlier and this had seen a reduction in littering.

·  Littering did not take place just outside the shops.  Litter could be found up to four hundred yards away.

·  People congregating and drinking in the street could be intimidating.

·  There was a bus stop close to the premises which was used by young people.  This may encourage them to drink.

·  The shop still had a poster in the front window advertising alcohol.  This was contradictory to the condition requested by the police.

 

In summary, the applicant’s representative reported that should the license be granted then the advertising would be remove.  The applicant did not want to contribute to any existing problems with nuisance and litter and had a history of running similar premises without complaint.

 

The Licensing Sub-Committee carefully considered the report of the Chief Officer (Elections and Regulatory), the Statement of Licensing and Policy and the representations made at the hearing.

 

RESOLVED – That the application for a Premises Licence at 27 Station Road, Horsforth, Leeds, LS18 5BA be granted with the addition of the conditions agreed with West Yorkshire Police (as found in Appendix  ...  view the full minutes text for item 8.
