Election of the Chair

RESOLVED: Councillor Garthwaite was elected Chair for the meeting.

 

2.

Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

 

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance and Scrutiny Support at least 24 hours before the meeting)

3.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

Certification of Films – Leeds INDIs Film Festival Film Shorts pdf icon PDF 136 KB

The report of the Chief Officer Elections and Regulatory advises Members of an application for the certification of ten short films to be shown at Leeds City Museum, Leeds Art Gallery and Leeds Big Screen, Millennium Sq. The films will be shown as part of Leeds INDIs Film Festival between the 22nd and 26th February 2023.

The report of the Chief Officer Elections and Regulatory advised the Licensing Sub Committee of an application for the certification of ten films as a part of Leeds INDIs Film Festival to be held between 22nd and 26th February 2023 at Leeds City Museum, Leeds Art Gallery and Leeds Big Screen, Millennium Square.

 

Present at the hearing was the applicant, Eleanor Hodson, Film Festival Assistant in the Leeds City Council City Development Directorate.

 

The applicant had provided advance screeners and recommended classifications for each film. To assist Members with their deliberation, officers of the Licensing Authority had viewed the available films. The BBFC film classification guidance was made available to the members.

 

The applicant provided further context for the screenings. The films were intended to be shown on loop with no audio between films during the film festival.

 

RESOLVED: That the films to be screened as part of Leeds INDI’s Film Festival be awarded the following certifications:

 

·  Getting To The Moon – U

·  Boing Boing the Bouncing Sheep – U

·  Busy – U

·  Podenco – U

·  Chopping Wood Chips – PG

·  Music for the End of the World – PG

·  Vines – U

·  Bits and Bobs – U

·  The Last Straw – U

·  French Windows – U

Application to vary a premises licence held by Lord Pizza, 215A Bradford Road, Tingley, Leeds, WF3 2DN pdf icon PDF 110 KB

The report of the Chief Officer Elections and Regulatory requests Members consideration on an application to vary a premises licence made by Mr Feridon Ghaleh-Tak, for Lord Pizza, 215A Bradford Road, Tingley, Leeds, WF3 2DN.

The Committee received the report of the Chief Officer Elections and Regulatory regarding the application to vary the premises licence held by Lord Pizza, 215A Bradford Road, Tingley, Leeds, WF3 2DN.

 

In attendance were;

David Spereall, journalist

Fatima Ahmed, journalist

 

The Committee noted that there were three representations made in writing. The applicant did not attend the hearing and the Committee resolved to continue the hearing as scheduled.

 

The Legal Officer outlined the procedure.

 

The Licensing Officer presented the application, highlighting the following points:

 

·  The application was originally;

o  To extend late night refreshment until 03:30am.

o  To add on sales to the licence.

o  To extend the sale of alcohol hours to 24 hours, with on sales only taking place until 03:30am.

 

·  West Yorkshire Police withdrew their objection prior to the hearing, following agreement with the Applicant that licence conditions will be added requiring;

o  CCTV to be installed

o  Supervisor’s register to include the Designated Premises Supervisor’s details and be maintained

o  Incident Register to be utilised

o  No customers to leave the premises with an opened bottle of alcohol

o  The age verification shall be Challenge 25

 

·  Environmental Health withdrew their objection prior to the hearing, following agreement with the Applicant that the application be varied as follows;

o  Sale by retail of alcohol (on and off premises) 09.00am – 00.00am everyday

o  Provision of late night refreshment between 23.00pm and 00.00am everyday, as currently stipulated in the premises license)

The following conditions were also agreed for inclusion in the licence;

o  Bottles to not be placed in an external receptacle between 11pm and 7am to minimise noise disturbances for local residents

o  Noise from plant or machinery should not be heard from the nearest noise sensitive premises during the operation of plant or machinery. Plant and machinery should be regularly serviced and maintained to meet this level

 

·  The Applicant had provided the following additional details which were noted by the committee;

o  The premises has operated for 24 years

o  The applicant had previously managed a licensed restaurant for four years

o  The applicant had taken all necessary training

o  Details of the applicant’s involvement in community and charity endeavours

 

The Licensing Sub Committee considered all the information provided to them by the responsible authorities, residents and applicant, and regarded the 2003 Licensing Act.

 

RESOLVED: That the application to vary the premises licences held by Lord Pizza, 215A Bradford Road, Tingley, Leeds, WF3 2DN be granted subject to the conditions agreed with West Yorkshire Police and Environmental Health, and variation of the licensed hours, as agreed, to:

 

·  Sale by retail of alcohol (on and off premises) 09.00am – 00.00am everyday

·  Provision of late night refreshment between 23.00pm and 00.00am everyday, as currently stipulated in the premises license)

 

The meeting concluded at 10.55am.
