RESOLVED – To elect Councillor James Gibson to the Chair for the duration of the meeting.

Appeals Against Refusal of Inspection of Documents

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

3.

Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

The report of the Chief Officer Elections and Regulatory requested Members consideration on an application for the Variation of an existing premises licence made by Hanson33 Limited, for Number Thirty-Three, Town Street, Farsley, Pudsey, Leeds, LS28 5EN.

 

In attendance for the meeting were:

  • George Domleo, Flint Bishop LLP – Applicant’s Representative

  • Jay Weir, Area Manager on behalf of Hanson33 Limited – Applicant
  • Raymond Nelson, Instigator of the Petition – Objector
  • Barbara Campbell, Signatory of the Petition – Objector
  • Don Mort – Journalist

 

The Principal Legal Officer set out the procedure for the hearing. The objectors to the application requested the submission of photographs and video evidence as part of their representation. With the agreement of all parties the photographs and the video were shown at the hearing.

 

The Principal Licensing Officer presented the application and provided the following information:

  • The applicant is Hanson33 Limited. They had requested an extension to:
    • the terminal hour of the Sale by Retail of Alcohol and Live Music on Friday and Saturday evenings until 01:30 hours,
    • to extend the opening times of the premises on Friday and Saturday until 02:00 hours, and on a Sunday until 23:30 hours.
    • They had also requested the removal of a number of existing conditions attached to the licence under the Public Safety heading.
  • A copy of the current licence was attached at Appendix A, with a redacted version of the application to vary the licence attached at Appendix B.
  • A map showing the location of the premises was appended to the report at Appendix C.
  • It was noted that any representation may be negotiated prior to the hearing. In this instance the operating schedule had been amended to include the measures agreed with West Yorkshire Police. A copy of the representation and agreement was appended to the report at Appendix D.
  • The application had attracted a petition signed by 44 individuals who opposed the application on the grounds of each of the four of the licensing objectives: Crime and Disorder, Public Safety, Public Nuisance and The Protection of Children from Harm.
  • A redacted copy of the petition was attached to the report at Appendix E, and an original copy was provided to the Licensing Sub Committee in advance of the hearing.
  • A list of premises in the local area and their licensed hours and activities was provided at Appendix F of the report.

 

Mr Domleo provided the following information on behalf of the licence holder:

  • Mr and Mrs Hanson had held the licence of the premises since 2018. They also had other premises which were The Princess at Rawdon and The Thornhill Arms at Calverley. No incidents had been recorded at any of the premises.
  • Farsley is a vibrant area with 26 venues, which are a mix of pubs, music venues and restaurants. Thirty-Three is in middle of Town Street.

The report of the Chief Officer Elections and Regulatory presented an application for the Grant of a Premises Licence for Golden Swan, 393 Dewsbury Road, Hunslet, Leeds, LS11 5LR.

 

Prior to the hearing Members of the Sub-Committee had been advised by the Principal Licensing Officer that the applicant and the officer for the Environmental Protection Team who had submitted representation against the application, were still in negotiations. Therefore, the applicant and the Environmental Protection Team officer had requested that this application be deferred to another date.

 

RESOLVED – To defer to the 4th March 2025, so that discussions between the applicant and the Environmental Protection Team officer could continue.

The report of the Chief Officer, Elections and Regulatory set out an application for the variation of a Premises Licence held by Carousel & Home,117 Albion Street, Leeds, LS2 8DY.

 

In attendance for the meeting were:

  • David Nejrup – Operations Director for Lindum Leisure Ltd - Applicant.
  • Michael Bolton – DPS - Applicant
  • Mr Whitfield – Management Team for K2
  • Don Mort - Journalist

 

The Principal Legal Officer set out the procedure for the hearing.

 

The Principal Licensing Officer presented the application to the Sub Committee providing the following information:

  • On the 22 January 2024 an application to transfer the licence to the current holder, Lindum Leisure Limited, was received and granted as applied for. A copy of the current licence was attached at Appendix A of the report.
  • The application was to extend the following licensable activities/timings:
    • Sale by retail of alcohol, Live Music, Record Music, Performance of Dance and Entertainment of a Similar Description Sunday to Thursday 11:00 to 04:00 Friday & Saturday 11:00 to 05:00.
    • Late Night Refreshment Sunday to Thursday 23:00 to 04:00 Friday & Saturday 23:00 to 05:00.
    • Opening hours to the public Sunday to Thursday 11:00 to 04:30 Friday & Saturday 11:00 to 05:30
  • A copy of the redacted application form was appended to the report at Appendix B. It was noted that the applicant had not offered any additional measures to promote the licensing objectives, however some information has been provided in ‘Section M’ of the application form.
  • At Appendix C was a map identifying the location of the premises.
  • Representations had been received from West Yorkshire Police and the

Environmental Protection Team in their capacity as responsible authorities. However, the representations had been withdrawn following the applicant agreeing with both agencies to adopt additional measures. Copies of the representations and agreements were appended to the report at Appendix D in respect of West Yorkshire Police, and at Appendix E in respect of the Environmental Protection Team.

  • Entertainment Licensing had received three individual letters of objection, all of which were opposed to this application on the grounds of public nuisance. To protect personal data, redacted copies of the representations were attached at Appendix F and the original versions were provided to the Licensing Sub Committee in advance of the hearing.
  • It was noted that the premises are located within the cumulative impact area for Leeds City Centre, albeit not in either of the two areas of special concern designated as “Red Zones”. Details of the cumulative impact policy specific to the City Centre and an outline of the evidence behind the reason for setting this policy was attached at Appendix G of the report.
  • A list of premises in the local area and their licensed hours and activities was provided at Appendix H.

 

Mr Nejrup provided the Sub-Committee with the following information:

  • Carousel and Home have 5 licensed premises in their portfolio 2 of which are nightclubs. All operate to the 5 Star Licence Savy Scheme.

9.

The  advise the Licensing Sub Committee Members of an application for the certification of a number of Sudanese Short Films to be screened 29th January 2025, at Hyde Park Picture House, 73 Brudenell Road, Headingley, Leeds LS6 1JD.

The report of the Chief Officer Elections and Regulatory advised Members of an application received from Hyde Park Picture House to certify a number of Sudanese short films due to be screened on 29th January 2025, Hyde Park Picture House, 73 Brudenell Road, Headingley, Leeds LS6.

 

It was noted there was no requirement for the Sub-Committee to view the films as the request was to award an 18-rating subject to a written declaration confirming that the films do not contain any content which would more likely than not, render them liable to be classified as R18 if considered in accordance with the BBFC Classification Guidelines. A link to the BBFC Classification Guidelines had been available for Members information within the submitted report.

 

The distributor had included the synopsis, further details on the screening and the declaration referred to above. A copy of the report was appended at Appendix A.

 

Members were advised that should the Sub-Committee have any questions then a representative of Hyde Park Picture House could be contacted via telephone. The Sub-Committee had no questions.

 

RESOLVED – To award each the following:

  • Africa, the Jungle, Drums and the Revolution (1977) – 18 Certificate
  • A Camel (1981) – 18 Certificate
  • The Station (1989) – 18 Certificate
  • Hunting Party (1964) – 18 Certificate
