3.

To receive and consider the attached report of the Head of Elections Licensing and Registration which sets out details of an application for the certification of films to be shown at Hyde Park Picture House.

The report of the Head of Elections, Licensing and Registration presented the Sub-Committee with an application to certify films to be shown at the Hyde Park Cinema.

 

The Licensing Officer presented the report and informed the Sub-Committee that the application had been received as the films had not been classified by the BBFC.  The report outlined a brief synopsis of the films to be shown and the proposed classification for ach along with reasons why.

 

Wendy Cook of the Hyde Park Picture House gave the Sub-Committee a summary of the films to be shown.  The following was highlighted:

·  Dawson City – This film had no content of an explicit nature.  There were no scenes with sexual content or that involved swearing or violence.  It was recommended that the film received a U certification.

·  Norther Soul – This film had a proposed certificate of 15 from the BBFC.  It was reported that the film was borderline12A/15.  There were no scenes of sex or violence but was one incidence of swearing and references to drug use and domestic violence.  It was proposed that the film should receive a 12A certificate.  Although attendance would be predominantly adults, this would allow older children to attend with guardians.

·  Milford Graves Full Mantis – This film had no nudity, sexual content, swearing or violence.  It was recommended that it be granted a U certification.

 

After careful consideration of the application, report and the information presented, the Licensing Sub-Committee:

 

RESOLVED – To approve the application as applied for.

Application for the grant of a premises licence for Bewar Food Store 39A Harehills Road, Harehills, Leeds, LS8 5HR pdf icon PDF 104 KB

The report of the Head of Elections, Licensing and Registration presented an application for the grant of a Premises Licence for Bewar Food Store, 39 A Harehills Road, Harehills, Leeds.

 

The application was for the sale by retail of alcohol every day from 09:00 to 23:00.

 

The Licensing Officer presented the application.  The application had not received any representations from the responsible authorities but had received representations form local Ward Members and residents.

 

Mr Satpal Roth addressed the Sub-Committee on behalf of the applicant.  He reported that the applicant had leased and operated the premises since May 2015.  At that stage, the landlord imposed a condition that alcohol was not to be sold from the premises but that had now been removed.  Further issues highlighted included the following:

 

·  The applicant would promote the licensing objectives – CCTV was in operation at the premises, risk assessments had been carried out and bins were provided.

·  There were two other licensed premises within the vicinity that sold alcohol.  The applicant wished to sell alcohol and open later due to commercial competition.

·  The applicant had a full understanding of responsibilities with regard to holding a premises licence and there had not been any representations from the responsible authorities.  It was acknowledged that there had been problems in the Harehills area but these could not be contributed to this applicant or operation of the premises.

·  The applicant would only employ trained licensed premises staff and DBS checks would also be carried out on staff.

·  CCTV footage would be kept for a minimum of 31 days.

·  Challenge 25 policy would be in operation at the premises.

·  In response to questions from the Sub-Committee it was reported that only a small, behind the counter, section of the premises would be used for alcohol.  There would be a small selection of beers and wines and single cans would not be sold.

 

The Licensing Sub-Committee carefully considered the report of the Head of Elections, Licensing and Registration along with the Statement of Licensing Policy, representations submitted and those made at the hearing.

 

RESOLVED – That the Licence be granted as a applied for.
