To seek nominations for the election for the position of Chair.

RESOLVED – To elect Cllr Hinchliffe as Chair for the duration of the meeting.

To consider any appeals in accordance with Procedure Rule 15.2 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

(*In accordance with Procedure Rule 15.2, written notice of an appeal must be received by the Head of Governance and Scrutiny Support at least 24 hours before the meeting)

There were no appeals.

1)  To highlight reports or appendices which:

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

c)  If so, to formally pass the following resolution:-

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

2)  To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

There were no exempt items.

There were no formal late items. However, supplementary information was received regarding:

·  Agenda Item 6 – Off Licence, 81 Roundhay Road, Leeds, LS8 5AQ. Statement provided by the applicant.

·  Agenda Item 7 – Leeds Young Film Festival on Tour. Officer’s comments and recommendations.

To disclose or draw attention to any interests in accordance with Leeds City Council’s ‘Councillor Code of Conduct’.

No interests were raised.

To receive and consider the attached report of the Chief Officer (Elections and Regulatory) regarding an application for the certification of eleven short films to be shown at The Carriage Works, Millennium Square, LS2 3AD and Lotherton Hall, Lotherton Lane, LS25 3EB. The films will be shown as part of Leeds Young Film Festival on Tour (Halloween), taking place from 20th October 2024 to mid November 2024.

The report of the Chief Officer, Elections and Regulatory advised Members of an application for the certification of eleven short films to be shown at The Carriage Works, Millenium Square, LS2 3AD and Lotherton Hall, Lotherton Lane, LS25 3EB. The films will be shown as part of Leeds Young Film Festival on Tour (Halloween), taking place from 20^th October 2024 to mid-November 2024.

Supplementary information was published on the Council’s website and distributed to members in the form of officer’s comments regarding each of the films. It was noted that there are concerns with 3 of the films, and officers have recommended the following:

·  I See You – PG certification.

·  Pumpkin Boy – 12A certification.

·  A Night in the Camp Heebie Jeebie – PG rating.

It was noted that the promoter is available by telephone should Members have any questions for them.

The screenings are scheduled to take place between 1st and 17th November 2024 at Everyman Cinema, Vue Cinema in the Light, Hyde Park Picture House, Howard Assembly Room, Cottage Road Cinema, Leeds City Art Gallery, Headrow House, Chapel FM Seacroft, St Luke’s Cares Beeston, Mill Hill Chapel & The Old Fire Station, Gipton.

The report of the Chief Officer, Elections and Regulatory advised Members of an application for the certification of numerous films in respect of the Leeds International Film Festival 2024. Of the films which have been submitted requiring classification the exhibitor has provided links to screeners for the viewing of 2 feature length films, 7 short films and 15 music videos. Members are recommended to certify the films they cannot view as category 18 ratings.

Subject to the declaration provided by the distributor at “Appendix A” confirming that no content would be deemed R18 rated when considered in accordance with the BBFC Classification Guidelines, all films listed at “Appendix B” are to be certified 18 rated.

The report of the Chief Officer, Elections and Regulatory) advised Members of an application for the certification of 3 films, Bye Bye Love, The River and The Last Year of Darkness to be screened between 27^th October 2024 and 20^th November 2024, at Hyde Park Picture House, 73 Brudenell Road, Headingley, Leeds, LS6 1JD.

The request is made for the films to be awarded an 18 rating, subject to a declaration provided by the distributor, that the films do not contain any content which would more likely than not, render them liable to be classified as R18 if considered in accordance with BBFC Classification Guidelines.

The River – 18

The Last Year of Darkness – 18.

Prior to the start of the meeting, a Sub-Committee member was unable to attend. Best efforts were made to seek a third member, but such attempts were unsuccessful. Given this situation and in line with Licensing Procedure Rule 6, parties present are to be provided with an opportunity to agree a quorum of 2 Sub-Committee members.

When seeking agreement to proceed on that basis, all parties in attendance for Agenda Item 6, did not agree to a quorum of 2 Sub-Committee members. The representative in attendance from Leeds City Council’s Entertainment Licensing Section also referred to there being no representative from West Yorkshire Police due to illness. The latter of the meeting was therefore adjourned.

To receive and consider the attached report of the Chief Officer (Elections and Regulatory) regarding an application for the grant of a premises licence made by Mr Yakob Tadese, for an Off Licence at 81 Roundhay Road, Leeds, LS8 5AQ.

As per Minute No.8, the item was adjourned. It was therefore

RESOLVED – To adjourn the item to the Licensing Sub-Committee meeting scheduled to take place Tuesday, 5^th November 2024.
