ELECTION OF THE CHAIR

Minutes:

Councillor T Grayshon was elected Chair of the Licensing Sub-Committee for the duration of the meeting.


RESOLVED: Councillor T Grayshon in the Chair.

2.

APPEALS AGAINST REFUSAL OF INSPECTION OF DOCUMENTS

To consider any appeals in accordance with Procedure Rule 25 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

 

(*In accordance with Procedure Rule 25, written notice of an appeal must be received by the Chief Democratic Services Officer at least 24 hours before the meeting)

 

Minutes:

There were no appeals against the refusal of inspection of documents.

3.

EXEMPT INFORMATION - POSSIBLE EXCLUSION OF THE PRESS AND PUBLIC

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2) To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application  as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

Minutes:

There were no formal late items of business. The Sub Committee was in receipt of supplementary information submitted after the despatch of the agenda and despatched to all parties prior to the hearings in respect of the agenda item 6 “Work Media Centre” - an additional submission on behalf of West Yorkshire Police.

DECLARATIONS OF INTEREST

Members are reminded to declare any interests at the start of the hearing on each application for the purpose of Section 81 (3) of the Local Government Act 2000 and paragraphs 8 to 12 of the Members Code of conduct

"WORK MEDIA CENTRE" - APPLICATION FOR THE GRANT OF A PREMISES LICENCE FOR THE PREMISES KNOWN AS "WORK MEDIA CENTRE" 36 WHITEHOUSE STREET, HUNSLET, LEEDS, LS10 1AD pdf icon PDF 11 MB

To consider the report of the Assistant Chief Executive (Corporate Governance) setting out details of an application for the grant of a premises licence in respect of “Work Media Centre” 36 Whitehouse Street, Hunslet, Leeds, LS10 1AD.

The Sub Committee, having regard to the Licensing Act 2003, the Statement of Licensing Policy and the Statutory Guidance, considered the application and written submissions before them in respect of the application to grant a Premise Licence.

 

The Sub Committee heard from Pc. C. Arkle and Mr. R. Patterson, West Yorkshire Police, in objection to the application. Additional information provided by the Police in the relation to the application had been circulated to all parties prior to the hearing. Members also noted that the applicant had reached agreements with Leeds City Council Health and Safety Team and the Environmental Protection Team. Since the agreement had been reached between the applicant and the Environmental Protection Team, Mr. B Kenny informed Members that there had been two separate complaints in relation to noise breakout at the premises. Due to the complaints received Mr. Kenny informed Members that he wished to withdraw conditions numbered three and four in the agreement with the applicant and replace it with a condition to prohibit the use of external loud speakers at all times. The Sub Committee then heard from Mr. G. Higgins the applicant.

 

After careful consideration the Sub-Committee resolved to grant the application but placed conditions on the premises licence that were necessary and proportionate to promote the Licensing Objectives. In reaching their decision the Sub-Committee took into consideration that if there were concerns about a particular event at a particular venue the police had the ability to utilise the closure powers in Part 8 of the Licensing Act 2003.

 

RESOLVED: That the premises licence be granted with the following conditions.

 

Conditions:

·  All conditions in existence in the previous premises licence (Prem/02594/VO2) which relate to crime and disorder be transferred to the new premises licence.

·  That the agreements reached with the Health and Safety Team, as outlined in the Licensing Officer’s report, be added to the premises licence.

·  That the agreements reached with the Environmental Protection Team, as outlined in the Licensing Officer’s report, be added to the premises licence with the exception of  proposed conditions three and four which were removed by the Sub-Committee.

·  No external loud speakers will be used between 23:00 hours and 10:00 hours (the following day).

·  All external doors and windows will remain closed during any licensable activities except for entrance and egress to the premises.

 

These conditions were imposed to promote the licensing objectives of the prevention of crime and disorder, prevention of public nuisance and health and safety.
