RESOLVED – That Councillor R D Feldman be elected as Chair of the Sub Committee for the duration of the hearing

APPEALS AGAINST REFUSAL OF INSPECTION OF DOCUMENTS

To consider any appeals in accordance with Procedure Rule 25 of the Access to Information Procedure Rules (in the event of an Appeal the press and public will be excluded)

 

(*In accordance with Procedure Rule 25, written notice of an appeal must be received by the Chief Democratic Services Officer at least 24 hours before the meeting)

EXEMPT INFORMATION - POSSIBLE EXCLUSION OF THE PRESS AND PUBLIC

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2) To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application  as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

To consider the report of the Assistant Chief Executive (Corporate Governance ) setting out details of an application for the grant of a Premises Licence for “Tesco Express” 267B Selby Road, Osmondthorpe, Leeds, LS15 7JR

Minutes:

The Sub Committee considered an application for the granting of a premises licence for the premises to be known as “Tesco Express” located at 267B Selby Road, Osmondthorpe, Leeds, LS15 7JR

 

Having read the representation from the interested party the Sub Committee were concerned about the affect the premises trading until 23:00 would have on the licensing objectives. In particular, the protection of children from harm objective given the possible associated risk of proxy sales at the premises.

 

Members were persuaded that the applicant would take sufficient steps to protect children from harm as described in the submitted operating schedule.

 

Members also noted the extensive training package the applicant provided to its staff by way of written and formal training programmes. Taking this into account Members were of the opinion that the applicant had taken adequate measures to address the potential risk of proxy sales.

 

Members concluded that to grant the amended application would not undermine the licensing objectives.

 

RESOLVED – That the application be approved subject to the conditions specified in the submitted report in order to promote the protecting children from harm licensing objective

The Sub-Committee were informed that the applicant had reached agreement with all the objectors in respect of this application. All representations had been withdrawn prior to the hearing. Given the position that there were of no outstanding representations, the application was deemed granted.

 

RESOLVED: To note that all outstanding representations had been withdrawn prior to the hearing and the application was deemed granted.
