Exempt Information - Possible Exclusion of the Press and Public

 

1)  To highlight reports or appendices which:

 

a)  officers have identified as containing exempt information, and where officers consider that the public interest in maintaining the exemption outweighs the public interest in disclosing the information, for the reasons outlined in the report.

 

b)  To consider whether or not to accept the officers recommendation in respect of the above information.

 

c)  If so, to formally pass the following resolution:-

 

  RESOLVED – That the press and public be excluded from the meeting during consideration of those parts of the agenda designated as containing exempt information on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the press and public were present there would be disclosure to them of exempt information

 

2) To note that under the Licensing Procedure rules, the press and the public will be excluded from that part of the hearing where Members will deliberate on each application  as it is in the public interest to allow the Members to have a full and frank debate on the matter before them.

Under Section 17 of the Licensing Act 2003 (“the Act”) for a premises licence in respect of Tantric Blue 68-72 New Briggate, Leeds, LS1 6NU.

 

The premises currently hold a licence under the name of Black Diamond. The premises licence allows the provision of regulated entertainment, sale of alcohol and late night refreshment from the 1st and 2nd floors of the building.

 

The applicant is Illuminati Ventures Limited. The application is for

 

·  Exhibitions of Films

·  Live Music

·  Recorded Music

·  Performance of Dance

·  Anything of a similar description

·  Sale of Alcohol

Sunday to Thursday 12:00-05:00

Friday and Saturday 12:00-07:00

 

·  Late Night Refreshment

Sunday to Thursday 23:00-05:00

Friday and Saturday 23:00-07:00

 

Non standard times applied to be extended by 1 hour.

 

The premises has a sexual entertainment licence which allows the premises to provide entertainment of a sexual nature between the hours of 10:00pm and 04:00am Sunday to Thursday and between 10:00pm and 05:00am Friday and Saturday. The application is to include the lower ground and ground floors of the building, therefore, providing a licence to cover all four floors of the building. Existing licence to be surrendered if this application is successful.

 

The applicant has taken steps to promote the licensing objectives. Spencer Tregidgo is proposed as the designated premises supervisor.

 

Representations have been received from Leeds City Council Entertainment Licensing, Leeds City Council Planning Services, Leeds City Council Health and Safety and West Yorkshire Police in their capacity as responsible authorities. Agreements have been reached West Yorkshire Police and Leeds City Council Health and Safety.

 

There have also been representations from other persons. The main points of concern are that the premises may cause noise disturbance for nearby residents adding to the cumulative impact within the area. The licensing section is in receipt of two individual letters, one of which is from a local ward councillor.

 

Mr Whur acting as the Licence Holders Agent offered apologies for his clients explaining that he had, had contact with them from early hours of the day and they were experiencing difficulties with their journey along the M1 and with their vehicle. Mr Whurr did not expect his client to arrive in Leeds before 11:30am.

 

Tim Hart and Chris Sanderson from Leeds City Council Planning Services explained to the sub-committee that an application for the proposed changes at Tantric Blue are not due to go before the Planning Committee for consideration until 14th March 2013.

 

The Sub –Committee considered all the information and a discussion took place with all interested parties.

 

RESOLVED – The sub-committee adjourned the hearing until after the decision of the Planning meeting on 14th March 2013. The sub-committee agreed the next hearing date for 15th April 2013.
