Minutes:

Although there were no formal late items, the Sub-Committee was in receipt of the following additional information which had been circulated after the agenda was despatched:

·  e-mails confirming that, following several amendments to the original application in respect of the Asda store at Green Road Meanwood, the Council’s Environmental Protection Team had withdrawn their objection to the application (minute 109 refers).

The Sub-Committee considered an application made by Asda Stores Limited for Asda Supermarket 34 Green Road Meanwood LS6 under Section 34 of the Licensing Act 2003, to vary the premises licence.

 

The following were present at the meeting:

Mr Taylor – Applicant’s solicitor

Ms Howen – Manager of the Meanwood Store

Councillor Sobel - Ward Member

 

The Sub-Committee noted that the representation from the Environmental Protection Team (EPT) had been withdrawn following discussions to vary the original application.  However representations remained from local residents, with Councillor Sobel attending on their behalf

 

The applicant’s solicitor, Mr Taylor, outlined the application and stated that the company was seeking to trade from 07.00 – 23.00 across all of its stores but that hours of 06.00 – 00.00 every day had been sought to enable some flexibility.

 

Following discussions with the Council’s EPT the application had been amended to 07:00 – 23.00 Monday to Saturday, which was the store’s current opening hours, although the existing premises licence only allowed for alcohol to be sold from 8.00am onwards.  Therefore the earlier hour of 7.00am if approved would allow the full range of products to be sold during those hours.  As the size of the store meant that it had to abide by the hours allowed by the Sunday Trading laws, no extension of hours was being sought for Sundays.

The amended application also removed the need to the request to permit late night refreshment as the store would no longer be open until midnight.

 

In respect of the concerns received from local residents about the illuminated store sign, Mr Taylor advised that this would be turned off at appropriate times.

 

In view of the amendments made to the application, Councillor Sobel indicated that the residents would now be happy to support the application.

 

The Sub-Committee carefully considered the report; the written and verbal representations made on behalf of the applicant; the written representations from two local residents and from Councillor Sobel on their behalf.

The Sub-Committee noted that the application had been varied to:

·  the hours of sale of alcohol to be 07:00 – 23:00 – Monday- Saturday and no extension sought on Sunday

·  the removal of the request to permit late night refreshment

·  the closing time of the premises at 23:00

 

The withdrawal of the representation made by the Council’s EPT in

view of these amendments was also noted.

 

Bearing in mind the licensing objectives, the Sub-Committee resolved to grant the application as now applied for.

RESOLVED –

a)  To grant the application as now applied for and to remove the embedded conditions

b)   To note the concerns of local residents regarding the lighting from the signage and to recommend that the sign be turned off at appropriate times

The Sub-Committee considered an application made by Asda Stores Limited for Asda Supermarket Oldfield Lane Wortley LS12 under Section 34 of the Licensing Act 2003, to vary the premises licence.

 

The following were present at the meeting:

  Mr Taylor – Applicant’s solicitor

  Mr Coventry – Manager of the Wortley Store

 

Mr Taylor presented the application and advised that the store was currently limited by planning hours and that an application to amend these had been submitted.  Members were assured that there were no proposals to trade outside of the current planning hours.

 

In respect of the application for late night refreshment, Mr Taylor stated that there was no intention of opening a café at the premises but that this was required to enable patisserie and hot bread to be sold at all times.

 

The proposed trading hours were 07:00 – 23:00 but that 06:00 – 00:00 hours had been sought to allow flexibility, although these would be subject to the planning hours.

 

The Sub-Committee noted that representations had been received from a local resident but that he was not in attendance. Members decided to proceed on the basis of the written representation submitted by the local resident and questioned Mr Taylor and Mr Coventry on the issues of drinking around the premises referred to in the submitted representation. Mr Coventry advised that having taken over as manager around 10 weeks ago there had not been any incidents of drinking outside of the premises; that if this occurred it would be dealt with and the police involved if necessary. A check of the store’s records had also not revealed any complaints made about this issue.

 

The Sub-Committee carefully considered the report; the written and verbal representations made on behalf of the applicant and considered the written representation from a local resident.
