Minutes:

  The Licensing Sub Committee considered an application made under section 17 of the Licensing Act 2003 for a premises licence in respect of Siam Oriental Restaurant, 106A Harrogate Road LS7.

  Representations had been received from West Yorkshire Police; the Council’s Environmental Protection Team; Planning, local Councillors and a number of local residents.

  Present at the hearing were:

 

  Mr Thomas – applicant’s agent

  Ms Keassarin – director of the applicant company, Siam Square (Leeds) Ltd

  Mr Patterson – West Yorkshire Police

  Mr Ward – LCC Environmental Protection Team

  Councillor J Dowson – Ward Member

 

  The application as set out in the report before the Sub-Committee was for the grant of a premises licence for the sale of alcohol, live music, recorded music, performance of dance every day from 12:00 hours to 03:00 hours and for the sale of late night refreshment from 23:00 to 03:00 hours everyday.  Members noted that the premises were located in a cumulative impact area.

  Mr Thomas informed the Sub-Committee that prior to the commencement of the hearing, discussions had taken place with representatives from the responsible authorities and that agreements in principle had been reached which met the various objectors’ concerns.

  Mr Thomas stated that the application had been significantly amended and was now for all licensable activities to be until midnight each day, with the premises to close at 00.30 hours.

  Members were informed that Ms Keassarin was an experienced operator, having a restaurant in the City Centre.  In terms of the size of the restaurant, it was intended to have 70 covers on the ground floor and around 35 – 40 covers in the basement area.

  To meet the licensing objectives of preventing crime and disorder, ensuring public safety and preventing public nuisance, the applicant agreed that the licence would be conditioned with the following conditions as set out in the Council’s V6 pro forma document.  The conditions to be attached to the licence were:

 

PF001 ,PF002, PF003, PF006, PF007, PF008, PF009, PF010, PF012, PF014, PF022, PF023, PF024, PF034, PF037, PF055, PF056, PF058, PF059, PF060, PF066, PF069, PF073, PF074, PF075, PF0076, PF079, PF082 and PF085

 

The applicant also agreed that a minimum number of 70 covers would

be maintained at all times and food would be available during all opening hours.  Members were informed that proof of age would be required and that the premises would operate as a restaurant and not as a vertical drinking establishment or club.

  In view of the proposals made to meet the licensing objectives, all responsible authorities confirmed that they agreed to withdraw their original representations.  Councillor Dowson also confirmed that the concerns raised by local residents had been met and agreed that those representations could also be withdrawn.  Councillor Dowson stressed the difference between running a restaurant in a local area and the City Centre and urged the operator to engage with the local community.

  Having carefully considered all the information and noting that the application had been significantly changed; that the representations had now been withdrawn and bearing in mind the licensing objectives and the cumulative impact area, the Licensing Sub-Committee decided to exercise its discretion and to grant the amended application.

  RESOLVED – That the application, as amended, be granted, subject to the additional conditions set out above.
