Approve the waiver of Contract Procurement Rules 9.1 and 9.2 to enable the Council to award new contracts to Leeds Community Healthcare NHS Trust and GPs, who are existing providers of key public health services. New contracts are required as there is insufficient contract extension provision available to maintain existing services during the review and competitive procurement of public health key priorities including healthy lifestyles, healthy child pathway, NHS Health checks and Infection Control.
The overall value of these contracts is approximately £5.3 million per annum, and the proposed new contracts would start on 1st April 2015 for 2 years with extension provision in order to ensure services are not disrupted and time is allowed for review and competitive procurement.
Decision Maker: Director of Public Health
Decision published: 17/02/2015
Effective from: 05/03/2015
Decision:
It is recommended that the Director of Public Health approves the request to waive CPR 9.1 and 9.2 in order to award new interim 2 year contracts (with extension provision) without competition to the following existing providers:
Leeds Community Healthcare NHS Trust
GPs
Awarding new contracts without seeking competition to these existing providers will ensure stability and continuity of key public health services whilst providing a sufficient period for the Public Health Direcotriate to work with Public Private Partnerships and Procurement Unit (PPP & PU) to undertake strategic reviews and competitive procurements of key public health priorities including Healthy Lifestyles (including smoking cessation), Healthy Child Pathway, NHS Health checks and Infection Control. The new contracts will also align with the contract end dates for the Health Visiting and Family Nurse Partnership services to enable a full service review of the Healthy Child Pathway (0 to 19 years) to be undertaken if required.
The total annual value of these contracts is £5,175,900.

In July 2014, the government announced the
‘Growth Deal’ for Leeds City Region – that is,
the allocation of funding for local projects and programmes
supporting the creation of jobs and the acceleration of growth.
Funding begins in April 2015, and, including support for the West
Yorkshire plus Transport Fund, the LEP has secured over £70m
for the coming financial year and £573m overall for the
period to 2020-21. As part of the preparation for delivery, the LEP
team needs to develop project management, monitoring and evaluation
arrangements, as well as assist with further project development
and appraisal for the capital projects that have been successful in
attracting support. The current staffing resources available to the
team are insufficient to carry out the necessary work. This
decision involves the engagement of VG Analytics to provide the
required resources and skills to ensure the work can be completed
quickly and to a high enough standard.

Adult Social Care has £2.34 million worth of contracts for a range of services with 3rd sector mental health providers. The current end of contracts date is March 2016, although plans to re-procure these services have been underway for some time it is now clear that that it will be helpful to review the place of these contracts in the context of a city wide strategic mental health planning and development process – the Leeds Mental Health Framework (2014-2017).
The purpose of this report is to request a waiver of Contract Procedure Rules (CPRs) 9.1 and 9.2 using the authority set out in CPR 1.3 to enter into a new contract with the existing 3rd sector mental health providers listed in appendix 1 for a further year until 31st March 2017 to allow time to properly explore the place of these services within the whole city mental health system and potential further integration between social care and health service mental health commissioning and provision.
