The Director of Public Health Noted -

The Health Protection (Coronavirus, Restrictions) (England) (No. 3) Regulations 2020 came into force on 18th July 2020 (referred to as the Regulations).


The Regulations give the power to ‘the local authority’ to issue a Direction Notification, the designated officers are:-

The Director of Public Health (and sub-delegated to the Deputy Director of Public Health, Leeds City Council in any absence).

Whose delegated powers include those to prevent the spread of a highly infectious disease being COVID-19 in order to protect the Leeds population by using powers under:


Officer Delegation Scheme (Executive Functions), 2) Health Protection Functions, c) providing the lead in public health incidents, and d) Communicable and infectious disease control; and
Director’s Sub-Delegation Scheme, Specific Delegations 2d; and 9c of the Miscellaneous Functions from the Director of Adults and Health sub-delegation scheme – responding to emergencies that present a risk to public health.

What decision has been taken?

Authorisation is given to issue a Direction that the event of a fun fair on land at Compton Road, Harehills in Leeds, be prohibited in order to protect the Leeds population and the populations of surrounding Local Authorities from the significant Public health risk of COVID-19 and the spread of this highly infectious disease.

A brief statement of the reasons for the decision -


The Authority considers that the following conditions required under the Regulations are met -



1: This direction responds to a serious and imminent threat to public health;

The Leeds 7 day infection rate has shown an upwards trend over the last week with case numbers tripling during this time period and infection rates increasing. These new cases are clustered in areas that are in close proximity to the proposed funfair.


Furthermore this is an area of Leeds which due to being an area of higher deprivation, higher BAME population; has a population with higher rates of smoking and obesity, and other underlying health conditions all of which are linked to poorer outcomes from COVID-19.

An event of this nature is likely to lead to more people congregating within a small area, including on the way to and from the event. This will increase the likelihood of people from different households coming into closer proximity with each other, increasing the risk of transmission of COVID-19 and worsening the local situation.



2: This direction is necessary for the purpose of preventing, protecting against, controlling or providing a public health response to the incidence or spread of infection by coronavirus in the Authority’s area;

The data demonstrates clear evidence of ongoing and heightened transmission of COVID-19 in the immediate locality. Allowing an event such as this to take place that would lead to numbers of people congregating together represents a threat to ongoing measures to contain the virus and limit its transmission.


Recent trends are showing a rise in cases in younger people and young adults, in particular women, who may be the audience for the fair, or bringing their children. The latest evidence suggests that between 10-35% of people have no, or few symptoms and could therefore transmit the infection unknowingly.



3: The prohibitions, requirements or restrictions imposed by this direction are a proportionate means of achieving that purpose;


Whilst thorough and in compliance with current guidance, the risk assessment provided by the event holder is unable to address the concerns relating to the congregation and travel of groups to this event. Holding the fun fair poses an additional, unnecessary risk to the local spread of infection in a context of rising infection rates and the prevention of the event is the only and proportionate response to the current situation.

The rates in Leeds and in this area have only risen significantly over the last week and therefore this decision could not have been made earlier.

The Director of Public Health noted and agreed that:-

Due to the global Public Health emergency COVID-19 pandemic, the Leeds Outbreak plan and the Test and Trace programme there is a need to scale up the Health Protection team.


The Director of Public Health has key responsibilities on behalf of the Council to manage the outbreak plan and due to the significant increase in need for specialist support and advice approval is sought to immediately increase the Public Health, Health Protection team by 2 x PO4 Advanced Health Improvement Specialists (Health Protection) on a temporary basis for 12 months.


These posts are exempt from the current recruitment controls due to being funded by the Test and Trace ring-fenced grant, in addition the post falls within the boundaries of the recruitment and staff control guidance set out on the 10th June 2020 as the posts will lead on statutory and preventative work and services for Health Protection.


The Government has provided £300m to Local Authorities in England for the Test and Trace programme, Leeds has received a £4,141,249 non-recurrent ring-fenced grant. The costs for these two posts for 12 months will be approximately £98k – £106k.


To increase the capacity of the LCC Public Health, Health Protection Team by recruiting 2 x PO4 Advanced Health Improvement Specialists on a temporary 12 month contract to deliver infection prevention elements of the Leeds Covid-19 outbreak management plan including the new national COVID-19 NHS Test and Trace programme.



A brief statement of the reasons for the decision[1]

These posts are integral to ensuring existing health protection arrangements are in order to prevent and manage infection and outbreaks in Leeds. These posts will provide public health expertise and coordination to the prevention and management of infections and outbreaks in the community, responding flexibly when needed. The response required is not straight forward and will likely require a high level of public health expertise, coordination and management depending on local need.


Approval is sought for post release and external advertisement of the vacancies on the condition that an attempt is first made to fill the post internally within the Council through redeployment and internal advertisement.


It is anticipated that the approximate annual cost of each post will be £48,996-£52,856 including on-costs. There will be additional costs for travel expenses and the purchase of IT equipment for 2 of the posts. Funding for the 2.0 FTE temporary 12 month posts will come from the Test and Trace ring fenced grant.


We need to ensure that the LCC Public Health, Health Protection Team has adequate resource to provide a resilient, effective and responsive service that can manage the increased demands of COVID -19 on a more sustainable footing during the pandemic.


There is significant work needed to respond to the pandemic and this will include implementing the Test and Trace programme and managing local COVID-19 outbreaks across the city. In order to do this we need to rapidly increase the existing capacity of the LCC Health Protection team, as directed by the national COVID -19 Test and Trace programme in Leeds.


If these posts are not approved, Public Health will not be able to take forward and deliver the key aspects of Health Protection as there is no additional capacity within public health.


This will directly affect the delivery of the Leeds Outbreak plan specifically Public Health’s ability to provide public health expertise and management and prevention of outbreaks in high risk settings and communities of interest as such this poses a risk to the city.

a) Sanction the requirement to enter into an ‘Early Works’ agreement with the LLEP for Galliford Try PLC to deliver the ‘Early Works’ programme necessary to meet the critical path programme for construction of the East Leeds Free School. This will take the form of an ‘Early Works’ agreement between the authority and Leeds D&B One Ltd for the sum of £470,798.

b) Approve the expenditure of £470,798 from capital scheme number 33177 / EAS / 000 for the completion of the ‘Early Works’ programme at East Leeds Free School.
