21/12/2018 - Variation to the Community Home Care Contract to cover payment for a 2 week period of service user hospitalisation. ref: 48206    

The Director of Adults and Health will be asked to approve a variation to the Community Home Care Contract to enable a payment to be made to providers to cover a period of up to 2 weeks whilst a service user who is receiving a home care service is in hospital. Currently, no payment is made to a provider once a service user is admitted to hospital which can cause difficulties in providers retaining staff and care packages being resumed once the service user is ready to be discharged. The payment will be made at the contracted rate per hour for the number of hours of care normally provided to that service user and for a period of up to 2 weeks. Payment will be made subject to providers ensuring staff receive their normal wage payment they would have received if the service user they are providing the service for had not gone into hospital. There will also be an expectation that a provider resumes the service immediately the service user is due to be discharged from hospital within the 2 week period.

21/12/2018 - Initiate contract extensions with BHA Skyline and Yorkshire MESMAC to enable key preventative public health services to be maintained ref: 48209    

 

This decision is seeking to initiate the available 2 x 12 months extension provision within the contracts with both BHA Skyline and Yorkshire MESMAC to deliver: HIV prevention and community testing services for black African communities and men who have sex with men. These contract extensions will ensure service continuity until 31st March 2021.  The annual value of these contract extensions is £276,370.

The Director of Adults and Health approved the recommendation of the variation under CPR 21.7 to enable the 4 Primary home care providers in the geographical management areas as defined in the community home care service contract (REF 9TNT-3CP1I0) to undertake a rapid response home care pilot, for the period 1st January to the 30th June 2019, with one option to extend for a further period of six months. This will enable the organisations to deliver a Rapid Response Home Care Service designed to enable individuals to be safely and effectively discharged from hospital once they are deemed medically fit (within 24 hours). The aim of this service is to ease pressure points such as achieving timely hospital discharges, enabling individuals to be cared for efficiently in the comfort of their own home, and to be assessed appropriately to meet their long term care and support needs.

 

The contracts and commissioning team will be responsible for implementation of this decision by January 2019.

The waiver of Contract Procedure Rules CPR9.1 and 9.2 - high value procurements - to enter into a 6month + 3month temporary contract with suppliers previously appointed to the Building & Specialist Materials Supply contract, utilising the same terms and conditions as the previous contract.

 

This waiver is the result of a previous procurement exercise, which has not concluded successfully due to the withdrawal of the intended provider during contract negotiations.

 

Therefore the waiver is required to support the continued supply of specialist building materials required for maintenance of the Council’s Civic Estates, to provide continuity of service delivery whilst we undertake a further compliant procurement process to implement a Managed Stores solution in line with our procurement strategy and in accordance with CPRs.

v) authorised the City Solicitor to advertise notices under the provisions of Section 23 of the Road Traffic Regulation Act 1984 and Section 90c of the Highways Act 1980 to advertise a Draft Traffic Regulation Order and if no valid objections are received, to make, seal and implement the Orders as advertised; and
vi) gave authority to negotiate the terms of and enter into an agreement with the developer under the provisions of Section 278 of the Highways Act 1980; whereby the works associated with the development are carried out by this Council at the cost of the developer.

Limited ("Albany") will replace lnterserve lnvestments Limited ("llL") in
the provision of management services to the LEP in respect of the
Leeds BSF Schools and Leisure projects.
The Directors are asked to note that to effect this change in service
provision, the LEP will enter into two deeds of novation and amendment
("LEP Deeds of Novation") of the two LEP MSAs under which such
management services are provided in respect of the Leeds BSF
Schools and Leisure projects.
ïhe Directors are also asked to note that the PFI MSAs under which the
LEP provides management services to the PFI contractors for BSF1,
BSF2 and BSF3 Schools and Leisure projects have expired and
therefore new PFI MSAs will be entered into (on substantially the same
terms)with an expiry date of 3 April 2022 ("New PFI MSAs").
ïhe Directors are recommended to approve the signing of a
shareholder's resolutíon of the LEP ("LEP Shareholder's Resolution")
which:
o resolves that the LEP shall enter into of the LEP Deeds of
Novation; and
